Ord. 415g2 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-91- 3a AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 11, "LANDSCAPING", ARTICLE 1, "IN GENERAL" SECTION 11-6, "INSTALLATION; APPROVED PLANT LIST; MAINTENANCE" BY REVISING SUBDIVISIONS (a), (d), (e) AND (f) AND ADDING NEW SUBDIVISIONS (g) , (h) AND (i) PROVIDING FOR THE ADOPTION OF THE STANDARDS OF THE NATIONAL ARBORIST ASSOCIATION; PROVIDING FOR ENFORCE- MENT BY THE CODE ENFORCEMENT DEPARTMENT; PROVIDING FOR PROPER MAINTENANCE OF LANDSCAP- ING IN THE CITY; PROVIDING FOR INSPECTIONS; PROVIDING FOR VIOLATIONS; PROVIDING FOR TREE PRUNING AND PERMITS THEREFORE; PROVIDING FOR EXEMPTIONS; PROVIDING STANDARDS FOR UTILITIES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Tamarac has experienced an increase in tree abuse; and, WHEREAS, the enforcement provisions of the landscape mainte- nance sections of the code are less than adequate to protect trees; and WHEREAS, the City Council of the City of Tamarac believes that it is in the best interests of the City to protect the local environment. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY • OF TAMARAC, FLORIDA: -SECTION 1 : Section 11-6 (a) of the Tamarac City Code is amended as follows: (a) All landscaping shall be installed in a manner according to accepted good planting procedures t DPW 1 Temp. Trees, hedges, zhzubs, ornamental., grasses and ground covers shall be as per the approved plant list in subsection (b) of this section and may be interchanged except where specifically limited in this chapter. All landscaped areas shall be protected from vehicular encroachment by either " big carstops or concrete curbing. All landscaping shall be provided with rustfree irrigation - be Wal SECTION 2: Section 11-6 (d) of the Tamarac City Code is amended as follows: (d) This chapter shall be a minimum standard and shall be enforced by O!rSbL Code =Qmcement Depattmpn:t of the City of . All landscaping shall be installed as specified on final approved landscape plans before request for a finalbt2ilding inspection is made by the appli- cant. If the landscaping requirements of this chapter have not been met at the time that a finalbuilding landscaRe inspection is requested, the owner or -h+s agent shall post with theftilding Zj= a cash bond of one hundred fifty (150) percent covering the previously estimated costs for a period of not more than sixty (60) days, after which time the City, may r at its option, take steps to correct the deficiency as per subsection (f ) of this section. ,SE!CITON 3: Section 11-6 (e) of the Tamarac City Code is amended as follows: (e) Any owner orkri-s,agent who fails to install and /or maintain the required landscaping as specified on the final approved landscape plan 2 No Text No Text No Text Temp.
