ORDINANCE NO. 0-91--_L
AN ORDINANCE AMENDING ARTICLE III OF CHAPTER 16 OF THE
CODE OF ORDINANCES OF THE CITY OF TAMARAC PERTAINING
TO THE CITY'S PENSION PLAN TO REDEFINE THOSE CITY
OFFICIALS AND EMPLOYEES WHOSE PARTICIPATION IN THE
PLAN IS OPTIONAL, PROVIDING FOR A REPEALER, PROVIDING
FOR SEVERABILITY AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the pension plan establishing the City of Tamarac
Employees' Pension Trust Fund now provides in Section
16-191(a)(4) that employees in specifically named classifications
have the election, upon employment or promotion, to participate
or not participate in the pension plan, and
WHEREAS, the classifications of employees who are
appropriate for voluntary exclusion from the pension plan may
change from time to time as the needs.of the City change and the
actual job titles and classifications held by such employees may
change, and
WHEREAS, the City Council by Resolution No. R-88-272 adopted
the "'Salary and Benefit Plan for Employees Outside the Bargaining
Units"' effective October 1, 1988, which has been, from time to
time, thereafter amended, and
WHEREAS, that Salary and Benefit Plan classifies certain
City employees as executive/managerial employees and provides
that said executive/managerial employees have the option of
participating in the City of Tamarac Employees' Pension Plan, and
WHEREAS, the Pension Board and the City Council wish to
amend the pension plan to be consistent with the City's Salary
and Benefit Plan for executive/managerial employees, and
WHEREAS, the City Council of the City of Tamarac determines
that it is in the public interest to adopt the following
Ordinance, and
WHEREAS, the following amendment has been approved by the
Board of Trustees of the City of Tamarac Pension Trust Fund;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THEI
CITY OF TAMARAC, FLORIDA:
That Article III, "'Employees' Pension Plan"',
Section 16-191(a)(4) is hereby DELETED and REPLACED with the
following:

$_ection 2: That all Ordinances or parts of Ordinance in
conflict herewith, be and the same are hereby repealed to the
extent of such conflict.
Section 2: Of any provision of this .Ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of this Ordinance that can,be given effect without
the invalid provisions or application, and to this and the
provisions of this Ordinance are declared to be severable.
Section is This Ordinance shall become effective October
1, 1988.
PASSED, ADOPTED AND APPROVED on first reading this day of
1991.
