CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 0-91- .57
AN ORDINANCE AMENDING ARTICLE III OF
CHAPTER 16 OF THE CODE OF ORDINANCES OF
THE CITY OF TAMARAC PERTAINING TO THE
CITY'S PENSION PLAN TO PROVIDE A DEADLINE
FOR PARTICIPANTS' FILING OF CLAIMS FOR
DISABILITY PENSION BENEFITS AFTER
TERMINATION OF EMPLOYMENT WITH THE CITY
OF TAMARAC; PROVIDING FOR A REPEALER,
PROVIDING FOR SEVERABILITY; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the Pension Plan does not presently provide a
deadline for a participant's filing of claims for disability
pension benefits after the termination of a participant's
employment with the City of Tamarac; and
WHEREAS, the Pension Board and the City Council wish to
modify the Pension Plan to require that a participant file a
claim for disability pension benefits within ninety (90) days
from the date of the termination of the participant's
employment with the City of Tamarac; and
WHEREAS, the Pension Plan establishing the City of
Tamarac Employee's Pension Trust Fund presently provides that
disability pension benefits are payable as of the date of a
participant's disability; and
WHEREAS, the Pension Board and the City Council wish to
modify the Pension Plan to provide for disability pension
benefits upon the actual date upon which participants file
claims for such disability retirement benefits; and
WHEREAS, the City Council of the City of Tamarac
determines that it is in the public interest to adopt the
following Ordinance; and
WHEREAS, the following amendment has been approved by
the Board of Trustees of the City of Tamarac Pension Trust
Fund:
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: That Article III, "PENSION PLAN", Section
16-227(a)(2) and (c)(4) of the Code of Ordinances of the City
of Tamarac are hereby amended to read as follows:

(a)(2) Has filed a claim for disability--beAefite
worker's compensation benefits, Social Security
disability benefits and long term disability insurance
benefits if offered by the City) , except this
requirement shall not apply to firefighters or police
officers.
(c)(4) Has filed a claim for disability--beaefibe ,
Social Security disability benefits and long term
disability insurance benefits (if offered by the City) .
SECTION 2: That Article III, "PENSION PLAN", Section
16-227 (a) and (c) of the Code of Ordinances of the City of
Tamarac is hereby amended by adding new subsections (a)(3)
and (c)(5) to read as follows:
(a)(3) Has filed a claim for disability benefits within
ninety 90 days from the termination of the
participant's emploXMent with the City of Tamarac or the
Sheriff of Broward County,
(c)(5) Has filed a claim for disability benefits within
ninety (90) days from the termination of the
participant's employment with the City of Tamarac or the
Sheriff of Broward County.
SECTION 3: That Article III, "PENSION PLAN", Section
16-228 of the Code of Ordinances of the City of Tamarac is
hereby amended to add the following subsection:
Lei All participants whose employment with the__City of
Tamarac or the Sheriff of BrowardCounty terminated
priorto the ado tion of this Ordinance shall file a
claim for disability, if -at all, within ninety __(90 )
days from the effective date of this Ordinance.
SECTION 4: That all Ordinances or parts of Ordinances
in conflict herewith be and the same are hereby repealed to
the extent of such conflict.

SECTION 5: If any provision of this Ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of this Ordinance that can be given effect
without the invalid provision or application, and to this end
the provisions of this Ordinance are declared to be
severable.
SECTION 6: This Ordinance shall become effective
immediately upon adoption and passage.
