AN ORDINANCE AMENDING PRIOR ZONING ORDINANCE,
0-82-43, PROVIDING FOR THE REZONING OF CERTAIN
q REAL PROPERTY FROM R-4 (APARTMENTS) TO B-5
(LIMITED BUSINESS DISTRICT);SAID LANDS BEING A
PORTION OF SECTION 6, TOWNSHIP 49 SOUTH, RANGE
41 EAST, BROWARD COUNTY, FLORIDA; OTHERWISE
IDENTIFIED AS BEING ON THE EAST SIDE OF NOB
HILL ROAD, APPROXIMATELY 800-FEET SOUTH OF
�p NORTHWEST 77 STREET; PETITION #68-Z-91;
PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING
�l MAP TO REFLECT SUCH CHANGE;. PROVIDING FOR
SEVERABILITY• AND PROVIDING AN EFFECTIVE DATE,

Sl WHEREAS, pursuant to the instruction of the City Council of
Y4 the City of Tamarac, Florida, public notice has been given in
3$ accordance with the applicable law of the time and place of
94 public hearing regarding the zoning of the property described
37 herein and the said public hearing has been held in accordance
34 with the notice and the public has been given an opportunity to
30 be, and has been heard; and the Council has examined and
2r investigated the request for the zoning herein and has received
2' the recommendation of the Planning Commission of the City of
22 Tamarac; and
21 WHEREAS, the Broward County Planning Council has requested
24 that the City amend its zoning map to bring certain parcels into
2$
conformance with the Broward County Land Use Plan;

WHEREAS, public hearing has been held on Petition #68-Z-91

by the City Council pursuant to the Charter.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF

TAMARAC, FLORIDA:

SECTION 1: That those lands described in Exhibit "A"

attached hereto and made a part hereof are hereby rezoned from

R-4 to B-5, using commercial flexibility as allowed in Flex Zone
7 61.
24 SECTION 2: That the official zoning map of the City of
Tamarac shall be changed to reflect such zoning, said changes to
be initialed by the Mayor and the City Clerk, together with the
effective date of this Ordinance.

SECTION 3: All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed to the extent of such
conflict.
SECTION 4: Should any section or provision of this
Ordinance or any portion thereof, or any paragraph, sentence or
word be declared by a Court of competent jurisdiction to be
invalid, such decision shall not affect the validity of the
remainder hereof as a whole or any part hereof, other than the
part declared to be invalid.
SECTION 5: This Ordinance shall become effective
immediately upon its final passage.
