AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA
AMENDING ARTICLE III OF CHAPTER 16 OF THE CODE OF
ORDINANCES PERTAINING TO THE CITY'S PENSION PLAN
TO PROVIDE A COST OF LIVING ADJUSTMENT BENEFIT FOR
PARTICIPANTS RECEIVING A NORMAL RETIREMENT
BENEFIT, PROVIDING FOR A REPEALER, PROVIDING FOR
SEVERABILITY; PROVIDING FOR INCLUSION; PROVIDING
WHEREAS, the City of Tamarac Employees' Pension Plan does not
presently provide a cost of living adjustment benefit to be paid
to participants receiving normal retirement benefits; and
WHEREAS, the Pension Fund Board of Trustees and the City
Council wish to modify the Pension Plan to provide a cost of
living adjustment benefit to participants receiving a normal
retirement benefit; and
WHEREAS, the City Council of the City of Tamarac determined
that it is in the public interest to adopt the following
Ordinance; and
WHEREAS, the following admendment has been approved by the
Board of Trustees of the City of Tamarac Employees' Pension Trust
Fund.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: That Article III, "PENSION PLAN" SEC. 16-228 of the
Code of Ordinances of the City of Tamarac is hereby amended to
add the following subsection:

any prior or subsegucnt annual period.
SECIIQN --2: That all or parts of Ordinances il'
conflict herewith be and the same are hereby repealed to the
extent of such conflict.
SECTION 3: If any provision of this Ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of this Ordinance that can be given effect without
the invalid provision or application, and to this end the
provisions of this Ordinance are declared to be severable.
SECTION 4: This ordinance shall become effective immediately
upon adoption by the City Council.
