AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TAMARAC, FLORIDA; REVISING CHAPTER 19 OF
THE TAMARAC CITY CODE ENTITLED "SOLID WASTE",
SECTION 19-3 ENTITLED "COLLECTION OF
RECYCLABLE WASTE" TO INCLUDE ALUMINUM AND
GLASS AS ADDITIONAL RECYCLABLES FOR SINGLE-
FAMILY CURBSIDE PARTICIPANTS; PROVIDING FOR
RECYCLING OF NEWSPAPER AND ALUMINUM FOR MULTI-
FAMILY HOMEOWNERS THAT RECEIVE DUMPSTER
SERVICE; PROVIDING FOR CODIFICATION;PROVIDING
FOR REPEALER; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AND EFFECTIVE
WHEREAS, on March 14, 1990 the Tamarac City Council passed
Ordinance No. 90-7 to provide for newspaper recycling at single-
family homes that receive curbside collection; and
WHEREAS, Ordinance No. 90-7 provided legislation for those
homeowners to segregate newspaper from all solid waste materials;
and
0 WHEREAS, on February 19, 1992 the Tamarac City Council passed
Resolution No. 92-22 approving an agreement to expand the single-
family curbside recycling program from newspaper to include glass
and aluminum and to implement a multi -family recycling program to
include newspaper and aluminum; and
WHEREAS, the City of Tamarac is an active participant in the
Joint Cities Recycling Program that includes the Cities of Coconut
Creek, Lauderhill, Margate, and North Lauderdale; and
WHEREAS, the Joint Cities Recycling Group has decided that
the second phase of its -program is ready for implementation; and
WHEREAS, implementation of the second phase will include the
recycling of newspapers, glass and aluminum, in single-family
residences and the recycling of newspapers and aluminum in multi-
family residences to be collected and recycled by a separate
contractor; and
WHEREAS, the cost to single-family homeowners and multi-
family homeowners is dependent upon participation rates, the City
Council of the City of Tamarac deems it to be in the best

interests of all City residents to adopt an ordinance requiring
the mandatory participation of all single-family residences in the
recycling program.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1, That the foregoing "WHEREAS" Clauses are
hereby ratified and confirmed as being true and correct and are
hereby made a specific part of this Ordinance upon adoption
hereof.
SECTION 2: That the Tamarac Code of Ordinances is hereby
amended by revising Section 19-3 "Collection of Recyclable Waste"
to read as follows:

comply with subparagraph a.of this section shall be
given a notice to comply. If thereafter the occupant
fails to comply, he/she shall be subject to the
penalties set forth in subparagraph e.2.. ,2,. below.
2. Penalties for the failure to comply with the
recycling program after receipt of the notice
to comply as provided in subparagraph e.!.e,.l. above or
for the unauthorized collection of recycling materials
shall be a fine of not less than $100.00 nor more than
$500.00, or imprisonment for a term not exceeding ninety
(90) days or by both such fine and imprisonment. Each
day shall constitute a separate offense.
,SEA CTTQN 3: Specific authority is hereby granted to codify
this Ordinance.
SECTION 4: All Ordinances or parts of Ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
S.FCTTON, 5, If any provision of this Ordinance or the
application thereof to any person or circumstance is held invalid,
such invalidity shall not affect other provisions or applications
of this Ordinance that can be given affect without the invalid
provision or application, and to this end the provisions of this
Ordinance are declared to be severable.
