CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 0-92-27
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA, AMENDING
CHAPTER 16 OF THE CODE OF ORDINANCES OF
THE CITY OF TAMARAC ENTITLED PENSIONS AND
RETIREMENT, ARTICLE III ENTITLED PENSION
PLAN BY ADDING SECTION 16-229.5 ENTITLED
SUBROGATION PROVIDING FOR A RIGHT OF
SUBROGATION; PROVIDING FOR CODIFICATION;
PROVIDING FOR A REPEALER; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
FFFECTTME SATE.
WHEREAS, the City of Tamarac Employees' Pension Plan does
not presently provide for the assertion of subrogation rights
against any third -party tortfeasors and/or insurance carriers for
the recovery of any disability pension benefit payments made in
connection with a participant's filing of a claim for disability
pension benefits; and
WHEREAS, the Pension Board of Trustees and the City Council
wish to modify the Pension Plan to authorize the Pension Board to
assert the Pension Plan's subrogation rights against third -party
tortfeasors and/or insurance carriers for the recovery of
disability pension benefit payments which the Pension Plan is
required to make in connection with a participant's claim for
disability pension benefits; and
WHEREAS, the City Council of the City of Tamarac determines
that it is in the public interest to adopt the following
Ordinance; and
WHEREAS, the following amendment has been approved by the
Board of Trustees of the City of Tamarac Employees' Pension Trust
Fund.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
,SUTTON -L That Article III, "PENSION PLAN", of the Code of
Ordinances of the City of Tamarac is hereby amended to add the
following section:

kSECTION. 2s Specific authority is hereby granted to codify
this Ordinance.
RECITON 3-- All Ordinances or parts of Ordinances in conflict
herewith be and the same are hereby repealed to the extent of
such conflict.
ACTION 4: If any provision of this Ordinance or the
application thereof to any person or circumstance is held
invalid, such invalidity shall not affect other provisions or
applications of this Ordinance that can be given effect without
the invalid provision or application, and to this end the
provisions of this Ordinance are declared to be severable.
,SECTION 5,, This Ordinance shall become effective immediately
upon adoption and passage.
