Ord. # 1608 Revised 6/9/92 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-92- AN ORDINANCE AMENDING PRIOR ZONING ORDINANCES, PROVIDING FOR THE REZONING OF CERTAIN REAL PROPERTY FROM B-6 (BUSINESS DISTRICT) TO R-3 (LOW DENSITY MULTIFAMILY DISTRICT); LANDS DESCRIBED AS THE EAST 380 FEET OF PARCEL "R" OF WOODLAND LAKES, PLAT BOOK 71, PAGE 18; OTHERWISE DESCRIBED AS BEING ON THE SOUTH SIDE OF MCNAB ROAD, EAST OF NW 88 AVENUE; PETITION # 38-Z 91; PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING MAP TO REFLECT SUCH CHANGE; PROVIDING FOR REPEALER; PROVIDING FOR SEVER - ABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instruction of the City Council of the City of Tamarac, Florida, public notice has been given in accordance with the applicable law of the time and place of public hearing regarding the zoning of the property described herein and the said public hearing has been held in accordance with the notice and the public has been given an opportunity to be, and has been heard; and the Council has examined and investigated the request for the zoning herein and has received the recommendation of the Planning Commission of the City of Tamarac;- and WHEREAS, public hearing has been held on Petition # 38 Z-91 by the City Council pursuant to the Charter. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That those lands described in Exhibit "A" attached hereto and made a part hereof are hereby rezoned from B-6 (Business District) to R-3 (Low Density Multifamily District). SECTION 2: That the official zoning map of the City of Tamarac shall be changed to reflect such zoning, said changes to be initialed by the Mayor and the City Clerk, together with the effective date of this Ordinance. SECTION 3: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. Temp. Ord. # 1608 Revised 6/9/92 SECTION 4: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to be invalid. Request: Rezone from B-6 to R-3. Legal Description: The east 380 feet of Parcel "R" of Woodlands Lakes, P.B. 71, P. 18 Location: South on McNab Rd.; East of NW 88 Ave. Findings of Fact: 1. On September 11, 1991, the City Council approved on first reading an application for a Land Use Amendment for the above referenced parcel from Commercial to Low Medium Residential (6-10 dwelling units per acre). 2. This request will rezone the property to conformity with the proposed Land Use Amendment. 3. Surrounding Land Uses and Zones are: Direction .—,... Land -Use Zoning North Commercial B-1 East Recreational S-1 South Recreational S-1 West Commercial B-2 4. The rezoning to R-3 will bring the existing buildings on the site into conformity with the City's zoning and building codes. The site will also have the proper density permitted by the Land Use Amendment.
