Ord. #1572 Rev. 6/18/92 13 'CITY OF TAMAR.AC, FLORIDA ORDINANCE NO. 0-92-,aE AN ORDINANCE OF THE CITY OF TAMARAC AMENDING THE CAPITAL IMPROVEMENT ELEMENT OF ITS ADOPTED COMPREHENSIVE PLAN BY AMENDING TABLE VIII-1 TO REFLECT THE CAPITAL IMPROVEMENT PROJECTS TO BE CONSTRUCTED BETWEEN 1991 AND 1996; PETITION NO. 3-LUA-91; PROVIDING REPEALER; PROVIDING FOR SEVERABILITY OF INVALID PROVISIONS; AND PROVID„LNG AN EFFECTIVE DATE. WHEREAS, the City of Tamarac has adopted a Comprehensive Plan which includes a Capital Improvement Element in accordance with the Local Comprehensive Planning and Land Development Regulation Act of 1985; and WHEREAS, the City of Tamarac, through its annual budget process, has identified certain capital improvement projects which have been completed during 1990-91; and WHEREAS, the State of Florida has implemented Florida Administrative Code Rule 9J-5 which sets forth capital improvements planning requirements for local governments; and WHEREAS, the City of Tamarac is a Charter City which has comprehensive planning powers; and WHEREAS, the City of Tamarac Charter requires that a five year capital program be prepared; and WHEREAS, the City wishes to preserve the health, safety, welfare, comfort, good order, appearance, convenience, law enforcement, fire prevention, and general welfare of the residents and corporate citizens of the City by adoption of a capital improvement element; and WHEREAS, the City wishes to protect and enhance the City's present advantages; and WHEREAS, the City wishes to encourage the most appropriate use of land, water, and other resources, consistent with the public interest; and WHEREAS, the City of Tamarac wishes to facilitate the. adequate and efficient provision of transportation, water, sewerage, park, recreational facilities, housing and other public facilities and services; and 1 Temp. Ord. #1572 WHEREAS, the City has used the data, facts, estimates, and projections contained in the the City's Comprehensive Plan and has applied the level of service standards to the City's needs assessment for the future years; and WHEREAS, the City has identified needs through its annual capital budgeting process; and WHEREAS, the Local Planning Agency held a hearing on August 21, 1991, and considered this amendment to the Comprehensive Plan; and WHEREAS, public hearings concerning this amendment to the Comprehensive Plan have been held by the City Council of the City of Tamarac on September 11, 1991 and June 24, 1992 pursuant to Chapter 163, Florida Statutes; and WHEREAS, the City Council of the City of Tamarac determines that it is in the public interest to adopt the following Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1. That the above mentioned whereas clauses are incorporated into this Ordinance as findings of fact. SECTION 2: The City of Tamarac hereby adopts this amendment to Table VIII-1 of the Capital Improvement Element, Petition No. 3-LUA-91. SECTION 3: The adoption of this amendment provides for the five year capital plan as required by the City Charter and provides for the annual capital budget. SECTION 41 All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: Should any section or provision of this Ordinance or any portion thereof, or any paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the remainder hereof as a whole or any part hereof, other than the part declared to , be invalid. 2 Temp.
