CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 0-93��
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA, AMENDING CHAPTER 2 OF THE
TAMARAC CITY CODE ENTITLED "ADMINISTRATION"
BY ADDING ARTICLE IX, ENTITLED "CABLE
TELEVISION", SECTION 2-366, ENTITLED "CABLE
TELEVISION RATE REGULATION"; TO PROVIDE FOR
CABLE TELEVISION RATE REGULATION CONSISTENT
WITH FEDERAL COMMUNICATIONS COMMISSION
REQUIREMENTS; PROVIDING FOR CODIFICATION;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, on August
26,
1993,
the
City Council passed
Resolution
No. R93-101, authorizing
the
filing
of
written certification
with the
Federal Communications Commission to obtain authority to engage in
Cable Rate Regulation in the City of Tamarac; and
WHEREAS, the City Attorney filed FCC Form 328, which was received
by the Federal Communications Commission on September 3, 1993; and
WHEREAS, FCC 328 calls for the franchising authority to adopt
within 120 days of certification and administer regulations with respect
to basic cable service that are consistent with regulations adopted by the
FCC pursuant to 47 U.S.C. Sec. 543(b).
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTIQU 1: The foregoing Whereas clauses are hereby ratified
and confirmed as being true and correct and are hereby made a specific
part of this Ordinance
upon
adoption
hereof.

Chapter
2 of the Tamarac Code of Ordinances
is amended to add Article IX, Section 2-366 as follows:

aECTION 2: Specific authority is hereby granted to codify this
Ordinance.
SECTION 3: All Ordinances or parts of Ordinances in conflict
herewith are hereby repealed to the extent of such conflict.
BECTION 4: If any provision of this Ordinance or the application
thereof to any person or circumstance is held invalid, such invalidity shall
not affect other provisions or applications of this Ordinance that can be
given affect without the invalid provision or application, and to this end
the provisions of this Ordinance are declared to be severable.

,SECTION 5: This Ordinance shall become erfective immediately
upon its passage and adoption.
