5 ORDINANCE NO. 0-94-
6 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
7 TAMARAC, FLORIDA, AMENDING CHAPTER 9 OF THE
TAMARAC CITY CODE, ENTITLED "HEALTH,
8 SANITATION, AND NUISANCES", ARTICLE III,
9 ENTITLED "NOISE", SECTION 9-87, ENTITLED
"PROHIBITED ACTS ENUMERATED" BY ADDING A
10 PROHIBITION OF POWERED MODEL VEHICLES IN .
PUBLIC RECREATION AREAS OR PARKS EXCEPT IN
11 SPECIFICALLY DESIGNATED AREAS; PROVIDING FOR
12 CODIFICATION; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
13 AN EFFECTIVE DATE.

WHEREAS, powered model vehicles in City recreational areas create
16
17 a noise level which interferes with the peaceful enjoyment of life for
neighboring residents; and

20 WHEREAS, the excessive noise emitted by powered model vehicles
21 limits the ability of citizens and residents to enjoy City recreational
22 areas and thereby limits the utilization of such public recreational areas;
and

25 WHEREAS, limiting the use of powered model vehicles in City
26 recreational areas will serve the public interest by allowing the maximum
27 enjoyment of public facilities by a greater number of citizens and
2$ residents; and

30 WHEREAS, the City Council of the City of Tamarac, Florida deems it
31 to be in the public interest to regulate the use of powered model vehicles.

33 NOW, THEREFORE, BE IT ORD r,,' IED BY THE CITY COUNCIL OF THE CITY
34 OF TAMARAC, FLORIDA:

ratified and confirmed as being true and correct and are hereby made

SE TION 2: That Article III, Section 9-87 of the Tamarac Coc
is hereby amended by adding Section 8 to read as follows:
Sec. 9-87. Prohibited acts enumerated.
The following acts, among others, are declared to be loud,
disturbing and unnecessary noises, and noises in violation of
this article, but this enumeration shall not be deemed to 'be
exclusive:

SECTION 3: It is the intention of the City Council and it is
hereby ordained that the provisions of this Ordinance shall become and b

may be renumbered,

to "Section", "Article"

or phrase in order to accomplish such intention.
SECTION 4: All Ordinances or parts of Ordinances in confli
herewith are hereby repealed to the extent of such conflict.
SECTION 5:
If any provision

Ordinance or
the applicatior
thereof to any person
or circumstance

held
invalid, such

not affect other provisions or applications of this Ordinance that can b
