Ord. #1688 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-94-Z_ AN ORDINANCE AMENDING PRIOR ZONING ORDINANCES, PROVIDING FOR THE REZONING OF CERTAIN REAL PROPERTY FROM R-1 C (SINGLE FAMILY RESIDENTIAL TO S-1 (RECREATION DISTRICT) LAND DESCRIBED AS PARCEL "R" OF HEATHGATE THIRD ADDITION P.B. 74 P. 16; PARCEL "R" OF SUNFLOWER FIRST ADDITION P.B. 78 P. 48; PARCEL "R" OF SUNFLOWER SUBDIVISION P.B. 76 P. ZZ; OTHERWISE DESCRIBED AS THE RECREATION AREA BETWEEN HEATHGATE AND SUNFLOWER RESIDENTIAL COMMUNITIES, BETWEEN NW 80 ST. AND NW 81 ST., EAST AND WEST OF NW 70 AVE.; PETITION NO. 6-Z-94; PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING MAP TO REFLECT SUCH CHANGE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PR VIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instruction of the City Council of the City of Tamarac, Florida, public notice has been given in accordance with the applicable law of the time and place of public hearing regarding the zoning of the property described herein and the said public hearing has been held in accordance with the notice and the public has been given an opportunity to be, and has been heard; and the Council has examined and investigated the request for the zoning herein and has received the recommendation of the Planning Commission of the City of Tamarac; and WHEREAS, public hearing has been held on Petition #6-Z-94 by the City Council pursuant to the Charter and Florida State Statutes and Me Temp. Ord. # 1688 WHEREAS, the City Council of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to rezone the property from R-1 C to S-1 and WHEREAS, the City Council of the City of Tamarac, Florida deems the rezoning to be consistent with the City of Tamarac Comprehensive Plan; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: E TI N 1: That those lands described in Exhibit "A" attached hereto and made a part hereof are hereby rezoned from R-1 C (Single Family Residential) to S-1 (Recreation District). SECTTON 2: That the official zoning map of the City of Tamarac shall be changed to reflect such zoning, said changes to be initialed by the Mayor and the City Clerk, together with the effective date of this Ordinance. SE TIQN 3: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. $ECJION 4 If any clause, section, other part or application of this Ordinance is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications or this Ordinance. -2- Temp.
