ORDINANCE NO.0-94- /9
AN ORDINANCE AMENDING PRIOR ZONING
ORDINANCES, PROVIDING FOR THE REZONING OF
CERTAIN REAL PROPERTY FROM B-1
(NEIGHBORHOOD BUSINESS DISTRICT) TO B-2
(PLANNED COMMUNITY BUSINESS DISTRICT);
LANDS COMMONLY KNOWN AS THE "TAMARAC
SHOPPING PLAZA" AND LEGALLY DESCRIBED AS
ALL OF THE BELIRO BUSINESS CENTER PLAT,
ACCORDING TO THE PLAT THEREOF AS
RECORDED IN PLAT BOOK 81, AT PAGE 3 OF
THE PUBLIC RECORDS OF BROWARD COUNTY,
FLORIDA; LOCATED ON THE SOUTHWEST
CORNER OF NW 66 TERRACE AND NW 57
STREET; PETITION NO. 19-Z-94; PROVIDING
FOR AMENDMENT OF THE OFFICIAL ZONING MAP
TO REFLECT SUCH CHANGE; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY;
AND PROVIDNG AN EFEECTIVE
WHEREAS, pursuant to the provisions of the Code of
Ordinances of the City of Tamarac, Florida, public notice has been
given of the time and place of the public hearing regarding the
rezoning of the property described herein and said public hearing has
been held in accordance with the notice and the public has been given
an opportunity to be, and has been heard; and
WHEREAS, the public hearing has been held on Petition
No. 19-Z-94 by the City Commission pursuant to the Charter and
Florida State Statutes; and
WHEREAS, the City Commission of the City of
Tamarac, Florida, deems it to be in the best interests of the citizens
and residents of the City of Tamarac to rezone the property from B-1
(Neighborhood Business District) to B-2 (Planned Community
Business District); and

WHEREAS, on September 21, 1994 the Planning
Commission held a duly advertised Public Hearing and recommended
approval of the rezoning; and
WHEREAS, the Director of Planning recommends
approval of this request; and
WHEREAS, the City Commission of the City of
Tamarac, Florida, deems the rezoning to be consistent with the City
of Tamarac Comprehensive Plan;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION
OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That those lands described in Exhibit "A"
attached hereto and made a part hereof are hereby rezoned from B-1
(Neighborhood Business District) to B-2 (Planned Community
Business District).
SECIIONThat the official zoning map of the City of
Tamarac shall be changed to reflect such zoning, said changes to be
made by the Director of Planning, together with the effective date of
this Ordinance.
,SECTION 3: All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed to the extent of such conflict.
5ECTION If any clause, section, other part or
application of this Ordinance is held by any court of competent
jurisdiction to be unconstitutional or invalid, in part or application,
it shall not affect the validity of the remaining portions .or
applications or this Ordinance.

EXHIBIT "A"
REZONING
Petitioner requests a raaoni:.y- cy the prcparty described on the
attached site plan and tax notice from the current "B-1
Neighborhood Business District" classification to the 11B-2
Planned Community Business District" classification pursuant to
Section 24-67 of the Tamarac City Code. City staff has
indicated that the adjoining parcels to the east and west of
this parcel are zoned B-2 and that this rezoning is consistent
with the Tamarac Comprehensive Plan. Parcels to the north of
the Property are zoned R-1. Commercial Boulevard, to the south
of the Property, divides a C-3 district in the City of
Lauderhill from the Petitioner's Property.
The site is operated as a shopping center and the rezoning will
allow more flexibility in the types of uses permitted.
Currently, twenty seven percent (27%) of the Shopping Center is
vacant and petitioner anticipates that the B-2 zoning category
will attract a greater number of tenants to the site. An
increase in occupancy will contribute to the City's tax base,
will benefit the condition and appearance of the Shopping
Center and will improve the surrounding neighborhood as a whole
without negatively impacting adjoining or nearby land owners.
