AN ORDINANCE OF THE CITY OF TAMARAC,
FLORIDA, AMENDING ORDINANCE NO. 0-89-44
OF THE CITY OF TAMARAC, FLORIDA, ADOPTING
A DEVELOPMENT ORDER FOR THE WESTPOINT
DEVELOPMENT OF REGIONAL IMPACT LOCATED
IN SECTION 7, TOWNSHIP 49 SOUTH, RANGE 41
EAST CONSISTING OF APPROXIMATELY 158
ACRES BOUNDED BY THE SAWGRASS
EXPRESSWAY ON THE WEST, COMMERCIAL
BOULEVARD ON THE SOUTH, AND NOB HILL
ROAD ON THE EAST, WITHIN THE CITY OF
TAMARAC, BROWARD COUNTY, FLORIDA, TO
PROVIDE FOR THE EXTENSION OF THE BUILDOUT
DATE, THE EXTENSION OF THE CONSTRUCTION
DATE OF HIATUS ROAD AND THE EXTENSION OF
THE DOWN ZONING OR REDUCTION OF DENSITY
OR INTENSITY DATE; PROVIDING FOR
CONFLICT; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Ordinance No. 0-89-44, adopted
on December 21, 1989, the City Commission of the City of
Tamarac approved with conditions a Development Order for the
Westpoint Development of Regional Impact on the property
described in Exhibit "A" of Ordinance No, 0-89-44 ("Site"); and
WHEREAS, CML Illinois Investment Group ("Applicant")
has applied to the City of Tamarac for an amendment of the
Development Order to provide for the extension of the buildout
date and the extension of the completion date for the

construction of Hiatus Road because development has not
progressed as rapidly as anticipated; and
WHEREAS, at its meeting of August 3, 1994, the
Planning and Zoning Board of the City of Tamarac reviewed the
proposed amendment and determined that it does not
constitute a substantial deviation and recommended approval
of the amendment to the Development Order for the Westpoint
Development of Regional Impact; and
WHEREAS, the City of Tamarac has reviewed the
proposed amendment pursuant to the criteria enumerated in
Section 380.060 9), Florida Statutes, and has determined that
the proposed amendment does not constitute a substantial
deviation from the approved Development Order in accordance
with Section 380.06(19), Florida Statutes;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION
OF THE CITY OF TAMARAC, FLORIDA:
SECTIQN1: That the foregoing whereas clauses are hereby
ratified and confirmed as being true and correct and are hereby
made a specific part of this Ordinance upon adoption hereof.
SECTION 2: That Section 6 of the Development Order,
Ordinance No. 0-89-44, is amended to read:

Exhibit "H", attached hereto and made a part

unless the City can demonstrate that
substantial changes in the conditions
underlying the approval of this
Development Order have occurred, or that
this Development Order was based on

substantially inaccurate information
provided by the Developer or that the
change is clearly essential to the Public
health, safety or welfare.
(R) Commencement of Development. The
deadline for commencing physical
development at the site shall be one year
from the effective date of this
Development Order. For purposes of this
paragraph, "physical development" means
site preparation or development of any
portion of the Site. The termination date
for completing development shall be Deco. beF
31, 1-994 December-3-0-1 ; provided that the
Developer, or his successors and assigns,
complies with section 6.1-1. The termination
date may only be modified in accordance
with Section 380.06(19)(c), Florida
Statutes.
SECTION 3: That except as amended herein, Ordinance No. 0-
89-44, adopted on December 21, 1989, is hereby ratified,
reaffirmed and in full force and effect.
SECTION 4: That within thirty (30) days of the effective date
of this amendment to the Development Order, the Applicant
shall record a notice of the adoption of an amendment to a
Development Order in accordance with the provisions of
Section 380.06(15)(f), Florida Statutes, and shall return a copy
of such recorded document to the City.
SECTION 5: If any clause, section, other part or application
of this Ordinance is held by any court of competent
jurisdiction to be unconstitutional or invalid, in part or

application, it shall not affect the validity of the remaining
portions or applications or this Ordinance.
SECTION L. That all Ordinances or Resolutions or parts of
Ordinances or Resolutions in conflict herewith, be and the
same are hereby repealed.
SECTION 7:This Ordinance shall become effective
immediately upon adoption.
