CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 0-95---L_
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, REPEALING CHAPTER 7,
ARTICLE IV, §§7-71 THROUGH 7-149 OF THE TAMARAC
CODE, ENTITLED "EXPLOSIVES"; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, blasting and the use of explosives in the City of Tamarac is an area of
great concern to the City Commission of the City of Tamarac; and
WHEREAS, Broward County Code, Chapter 12, regulates the use of explosives in
Broward County; and
WHEREAS, Broward County Code, Chapter 12 is more stringent than the City's
ordinances regarding explosives; and
WHEREAS, Broward County Code provisions contain the necessary technical
language required to protect the life and safety of Tamarac residents; and
WHEREAS, the Building Official has reviewed and compared the Broward County
Code of Ordinances and the City of Tamarac Code, and recommends that the Tamarac
Code provisions be repealed in favor of County enforcement in Tamarac of Broward
County Code provisions governing blasting; and

WHEREAS, the City Commission of the City of Tamarac deems it to be in the best
interest of citizens and residents of the City of Tamarac to repeal Tamarac municipal
ordinances regarding explosives.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: That the foregoing whereas clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Ordinance
upon adoption hereof.
SECTIONS That Tamarac City Code, Chapter 7, Article IV, entitled
Explosives, consisting of §§7-71 through 7-149 is repealed in its entirety.
SECTION 3_ All Ordinances or parts of Ordinances in conflict herewith are
hereby repealed to the extent of such conflict.
SECTION 4_ If any provision of this Ordinance or the application thereof to
any person or circumstance is held invalid, such invalidity shall not affect other provisions
or applications of this Ordinance that can be given affect without the invalid provision or
application, and to this end the provisions of this Ordinance are declared to be severable.

passage and adoption.
