A ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC,
FLORIDA; AMENDING CHAPTER 12, "LICENSE AND BUSINESS
REGULATIONS", ARTICLE II "OCCUPATIONAL LICENSES", SECTION 12-30,
LOCATION OF BUSINESS, APPLICABILITY OF ZONING REGULATIONS BY
ADDING SECTION 12-30 (F) TO PROVIDE FOR THE BUILDING OFFICIAL TO
REQUIRE A SAFETY INSPECTION OF THE PROPERTY IN ADDITION TO AN
EXISTING VALID CERTIFICATE OF OCCUPANCY, BEFORE THE ISSUANCE OF
THE OCCUPATIONAL LICENSE; PROVIDING FOR A MINIMUM STANDARD
SAFETY INSPECTION; PROVIDING FOR CODIFICATION; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE:
WHEREAS, the City Commission of the City of Tamarac, Florida has directed that the City Code
be reviewed and updated; and
WHEREAS, the South Florida Building Code no longer requires annual building inspections for
compliance to the code; and
WHEREAS, the Group of Occupancy remains the same; and
WHEREAS, the City Commission of the City of Tamarac, Florida has enacted Chapter 12,
Section 12-30 which sets forth stringent inspection requirements before the issuance of occupational
licenses; and
WHEREAS, the Building Official and City Manager have reviewed the City Code in parts and
recommends to revise Chapter 12, Article II, Section 12-30 to create the provision for certain business
establishments with new tenants to have a minimum safety inspection in addition to the existing valid
certificate of occupancy with the same group occupancy; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest
of the health, safety, and welfare of its residents and businesses of the City of Tamarac to provide a
minimum standard safety inspection for new commercial and professional tenants of existing buildings
and structures.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA-

ACTION 1: That the foregoing Whereas clauses are hereby ratified and confirmed as being
true correct and are hereby made a specific part of this Ordinance upon adoption hereof.
CTIQ,N 2: That the Tamarac City Code Chapter 12, Article II, Section 12-30 of the City Code
of Or inces is hereby amended by adding 12-30 (f) to read as follows:

W Before the issuance of the occupational license, it shall be the duty of the Quilding
Official to require a pre occupancy inspection for a minimum standard safety insp?,ction of
business establishments with new tenants in addition to the_ _existing certificate of
occupancy. This minimum standard safety inspection shall be performed by
certified structural electricalplumbing, mechanical and fire inspectors. This minim
standard safety inspection fee is the same as establishedfor Certificate of Occupancy
Inspections by Ordinance of the City Commission.
A minimum standard of safely inspection shall includp, those requirements for compliance
with the South Florida Building code such as but not limited -too:

3) Fire -resistance
4) Openings in walls
5) Electrical or ling equipmni
6) Fire, exting„u,ishina gppgratus
7) Handicap accessibility
8) NFPA 101 Life Safety Code

authority from at anytime requiring that these minimum standards of safety be
maintainQd cog the period of use of jb& building in accordance with the South
Florida Bljiilding Code in effect on the date of issuance of the permit or the.requirements
of N FA_101 Life Safety Code.

SECTION 3: It is the intention of the City Commission and it is hereby ordained that the provisions of
this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac,
Florida, and that the Sections of this Ordinance be renumbered, relettered and the word "Ordinance" may
be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention.
SECTION 4: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to
the extent of such conflict.
SECTION 5: If any provision of this Ordinance or the application thereof to any person or
circumstance is held invalid, such invalidity shall not affect other provisions or applications of this
Ordinance that can be given affect without the invalid provisions or application, and to this end the
provisions of this Ordinance are declared to be severable.
SECTION 6: Should any section or provision of this Ordinance, or any portion thereof, or any
paragraph, sentence or word be declared by a Court of competent jurisdiction to be invalid, such decision
shall not affect the validity of the remainder hereof, as a whole or part hereof, other than the part
declared to be invalid.
SECTION7: This Ordinance shall become effective immediately upon it passage and final
adoption.
