ORDINANCE NO. 0-95-17
AN ORDINANCE OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, AMENDING
TAMARAC CITY CODE CHAPTER 10 ENTITLED
"LAND DEVELOPMENT REGULATIONS",
SECTION 10-186 ENTITLED "PRIVATE
ACCESSWAYS", MAKING THE CHIEF
BUILDING OFFICIAL RESPONSIBLE FOR
ISSUING PERMITS FOR CONSTRUCTION OR
EXPANSION OF PRIVATE DRIVEWAYS, AND
INSPECTION OF SUCH CONSTRUCTION,
PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY, AND PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, there is duplication of the duties between the City Engineer and
Chief Building Official in permitting and inspection of private driveway construction;
and
WHEREAS, the Chief Building Official issues permits for construction and
expansion of private driveways; and
WHEREAS, the City Engineer inspects the construction and expansion of
private driveways without receiving inspection fees; and

WHEREAS, the Public Works Director, Chief Building Official
and City Engineer believe it is in the best interest of the City to revise City Code
Section 10-186; and
WHEREAS, the City Commission of the City of Tamarac finds it to be in the
best interest of the residents of the City to make the Chief Building Official
responsible for permitting and inspecting the construction and expansion of private
driveways.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA-
Section _1: That the foregoing whereas clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this
Ordinance upon adoption hereof.
Section 2: Sec. 10-186. Private accessways.
(a) Performance bonds and engineering inspection fees for accessways
which have not been included as part of previously approved site
development plans shall be in accordance with chapter 20 of this
Code.
(b) Location, and design, construction and expansion of all privgte
vehicular ingress and egress driveways between private property and

a public street shall meet the requirements of the eity emgineeF this
section and shall be covered by a driveway permit issued by the eity
e . chief building official and shall be consistent with o eratin
procedures of the City as they currently exist. Each drive will be
reviewed according to the conditions existing at each location or
according to known future conditions as determi- and inspected by
the eity engine chief building official.
Section 3� It is the intention of the City Commission and it is hereby
ordained that the provisions of this Ordinance shall become and be made a part of
the Code of Ordinances of the City of Tamarac, Florida, an that the Sections of this
Ordinance may be renumbered, relettered and the word "Ordinance" may be
changed to "Section", "Article" or such other word or phrase in order to accomplish
such intention.
Section 4: All Ordinances or parts of Ordinances in conflict herewith are
hereby repealed to the extent of such conflict.
Section 5: If any provision of this Ordinance or the application thereof to
any person or circumstance is held invalid, such invalidity shall not affect other

provisions or applications of this Ordinance that can be given affect without the
invalid provision or application, and to this end the provisions of this Ordinance are
declared to be severable.
Section 6: This Ordinance shall become effective immediately upon its
passage and adoption:
