Ord. #172-4 Page 1 May 17, 1995 Rev. 1 - June 13, 1995 Rev. 2 - January 29, 1996 Rev. 3 - April 29, 1996 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-96--x2, AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING ARTICLE VIII, SECTION 8.01, OF THE CITY CHARTER, ENTITLED "TERMS AND QUALIFICATIONS"; CHANGING THE CHARTER BOARD FROM AN ELECTED TO AN APPOINTED BOARD; PROVIDING FOR TRANSITION; PROVIDING FOR REMOVAL FROM OFFICE; PROVIDING FOR CONVENING OF CHARTER BOARD EVERY THREE (3) YEARS FOR A PERIOD NOT TO EXCEED SIX (6) MONTHS UNLESS EXTENDED BY RESOLUTION OF THE CITY COMMISSION; AMENDING SELECTION OF CHAIRMAN AND VICE CHAIRMAN; PROVIDING THAT IF THE AMENDMENT IS APPROVED BY A MAJORITY OF THE VOTERS AT THE SEPTEMBER 3, 1996 ELECTION, THEN SUCH AMENDMENT SHALL BECOME A PART OF THE CITY CHARTER UPON CERTIFICATION AND ACCEPTANCE OF THE ELECTION RESULTS; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac that Article VIII, Section 8.01, entitled "Terms and qualifications", be amended; and WHEREAS, pursuant to Chapter 166, Florida Statutes, a public hearing has been held on this matter. Ord. #JI24 Page 2 May 17, 1995 Rev. 1 - June 13, 1995 Rev. 2 - January 29, 1996 Rev. 3 - April 29, 1996 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1 _ The following referendum question amending the City Charter shall be presented to the electorate of the City of Tamarac at the September 3, 1996 election and if the following referendum question is approved by a majority of the electorate at said election, the amendment proposed shall become a part of the City Charter upon Certification and acceptance of the election results: PROPOSED AMENDMENT CHARTER BOARD CHANGED FROM ELECTED TO APPOINTED BOARD SECTION 8.01 OF TAMARAC CHARTER AMENDED CHANGING SELECTION OF CHARTER BOARD MEMBERS FROM ELECTED TO APPOINTMENT FROM DISTRICTS BY COMMISSIONERS AND AT LARGE BY MAYOR. CURRENT CHARTER BOARD MEMBERS MAY COMPLETE THEIR TERMS. APPOINTMENT OF MEMBERS BEGINS AS CURRENT CHARTER BOARD MEMBERS VACATE POSITIONS. APPOINTMENTS FOR TERMS CONCURRENT WITH APPOINTING OFFICIAL STARTING MARCH, 1998. APPOINTED CHARTER BOARD MEMBERS MAY BE REMOVED BY COMMISSION. CHARTER BOARD MEETS EVERY 3 YEARS FOR LIMITED TIME PERIOD. YES NO If the proposed amendment is approved, Article Vill, Section 8.01 entitled Temp. Eaeh yeaF, aAs soon as possible after new members have taken office, the board shall elect a chairman and a vice- chairman. {-e}(ftExtended Absence from Office. Any charter board member who is absent from three (3) consecutive regular board meetings or five (5) out of seven (7) consecutive regular board meetings shall forfeit his office. Any absence excused by the chairman shall not be counted as an absence for the purpose of this section. The charter board shall declare a vacancy due to its member's absence. The vacancy shall be filled pursuant to the provisions of this Charter. fd)LM Filling of Vacancy. SECTION 2: Codification It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION. a:Conflicts: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: Severabilitk If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. 1 1 �71 I iJ SECTION 5: Effective date: immediately upon its passage and adoption.
