Ord. #1750 1 April 24, 1996 Revision No. 1 - May 2, 1996 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-96-�6 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA; AMENDING CHAPTER 24, ARTICLE III, ENTITLED "DISTRICT REGULATIONS", SECTION 24-434, ENTITLED "BUSINESS AND COMMERCIAL USES MASTER LIST"; PROVIDING FOR THE ESTABLISHMENT OF ADDITIONAL PERMITTED BUSINESS AND COMMERCIAL USES IN CERTAIN BUSINESS AND COMMERCIAL ZONING DISTRICTS; PROVIDING FOR THE ELIMINATION OF CONFLICTING RESTRICTIONS PERTAINING TO SIMILAR BUSINESS AND COMMERCIAL USES IN CERTAIN BUSINESS AND COMMERCIAL ZONING DISTRICTS; PROVIDING FOR THE REMOVAL OF NON - COMPATIBLE BUSINESS AND COMMERCIAL USES FROM CERTAIN BUSINESS AND COMMERCIAL ZONING DISTRICTS; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFEQME WHEREAS, the City of Tamarac finds that there is a need to update the existing "Business and Commercial Uses Master List" in order to insure the compatibility of existing and proposed business and commercial uses in the various business and commercial zoning districts of the City to accommodate new and existing business and commercial needs; and CODING: Words in st+uelc-tfh type are deletions from existing law; Words in ,W„ndersgored type are additions. Ord. #1750 2 April 24, 1996 Revision No. 1 - May 2, 1996 WHEREAS, the City of Tamarac's present "Business and Commercial Uses Master List" has become obsolete due to changing needs of various existing and proposed businesses; and WHEREAS, the City of Tamarac's current "Business and Commercial Uses Master List" permits certain business and commercial uses that have proven to be incompatible with adjacent residential land uses in certain business and commercial zoning districts; and WHEREAS, the City of Tamarac finds that there is a need to prohibit the conduct of certain business and commercial uses that have proven to be incompatible with adjacent residential land uses in certain business and commercial zoning districts; and WHEREAS, the City of Tamarac finds that the current "Business and Commercial Uses Master List" contains conflicting restrictions pertaining to similar business and commercial uses in certain business and commercial zoning districts; and WHEREAS, the City finds that there is a need to eliminate existing conflicts in the current "Business and Commercial Uses Master List" in order to insure uniformity of restrictions pertaining to similar business and commercial uses in individual business and commercial zoning districts; and WHEREAS, the City of Tamarac encourages quality economic development which will enhance the City's tax base; and CODING: Words in stFuelt through type are deletions from existing law; Words in Mgderscored type are additions. 1 1 Temp. Ord. #1750 3 April 24, 1996 Revision No. 1 - May 2, 1996 WHEREAS, the Planning Commission recommended approval of the Ordinance amendment at a public hearing on May 1, 1996; and WHEREAS, the Director of Community Development recommends approval of this amendment; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to amend Chapter 24, Article III, entitled "District Regulations", Section 24-434, entitled "Business and Commercial Uses Master List"; providing for the establishment of additional permitted business and commercial uses in certain business and commercial zoning districts; providing for the elimination 'of conflicting restrictions pertaining to similar business and commercial uses in certain business and commercial zoning districts; providing for the removal of non -compatible business and commercial uses from certain business and commercial zoning districts from the City of Tamarac's "Business and Commercial Uses Master List". Ord. #1750 14 April 24, 1996 Revision No. 1 - May 2, 1996 SECTION I It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered, relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: All Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION I If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
