Ord. # 1730 Page 1 June 13, 1995 Rev. 1 - 1 /29/96 Rev. 2 - 2/7/96 Rev. 3 - 4/30196 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-96- 7 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING ARTICLE IV, SECTION 4.05, OF THE CITY CHARTER, ENTITLED "VACANCIES; FORFEITURE OF OFFICE; FILLING OF VACANCIES"; INCREASING FROM SEVENTY-FIVE (75) TO NINETY (90) AS THE NUMBER OF CONSECUTIVE DAYS WHICH RESULT IN FORFEITURE OF OFFICE WHEN A COMMISSION MEMBER IS ABSENT FOR ANY REASON FROM ALL REGULAR COMMISSION MEETINGS; PROVIDING THAT IF THE AMENDMENT IS APPROVED BY A MAJORITY OF THE VOTERS AT THE SEPTEMBER 3, 1996 ELECTION, THEN SUCH AMENDMENT SHALL BECOME A PART OF THE CITY CHARTER UPON CERTIFICATION AND ACCEPTANCE OF THE ELECTION RESULTS; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac that Article IV, §4.05 of the Tamarac Charter, be amended; and WHEREAS, pursuant to Chapter 166, Florida Statutes, a public hearing has been held on this matter. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The following referendum question amending the City Charter Temp. Ord. # 1730 Page 2 June 13, 1995 Rev. 1 - 1 /29/96 Rev. 2 - 2/7/96 Rev. 3 - 4/30/96 shall be presented to the electorate of the City of Tamarac at the September 3, 1996 election and if the following referendum question is approved by a majority of the electorate at said election, the amendment proposed shall become a part of the City Charter upon Certification and acceptance of the election results: PROPOSED AMENDMENT COMMISSION MEMBERS ABSENT FOR 90 DAYS FORFEIT OFFICE §4.05 OF THE TAMARAC CHARTER AMENDED TO INCREASE FROM 75 CONSECUTIVE DAYS TO 90 CONSECUTIVE DAYS AS THE PERIOD OF TIME THAT RESULTS IN FORFEITURE OF OFFICE WHEN A COMMISSION MEMBER IS ABSENT FOR ANY REASON FROM ALL REGULAR COMMISSION MEETINGS. YES NO If the proposed amendment is approved, Article IV, Section 4.05 entitled "Vacancies; forfeiture of office; filling of vacancies " will read as indicated below: Sec. 4.06. Vacancies; forfeiture of office; filling of vacancies. (b) Forfeiture of Office. A e-•.__ilmembe commission member shall forfeit his office if the member lacks, at any time during the term of office, any qualifications for the office as Temp. Any eouneilmernbecommis !� membe who is absent from all regular council meetings for any reason, over a period of seventy -five -(?5) ninety -consecutive days, shall forfeit his office. Any recess shall be included in the calculation of time provided in this section. CODING: Words in stmek through type are deletions from existing law; Words in unders type are additions. SECTION 2: Codification_ It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. 5ECTIO 3: nflic : All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4_ Severability: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared 1 1 to be severable.
