Ord. #1747 Revision #1 April 4, 1996 Revision #2 July 25, 1996 Revision #3 September 5, 1996 Revision #4 September 13, 1996 Revision #5 September 19, 1996 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-96--ij AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 15 OF THE CODE OF THE CITY OF TAMARAC, FLORIDA, "PARKS AND RECREATION'; AMENDING SECTION 15-1 "DEFINITIONS" TO CHANGE "PUBLIC WORKS DEPARTMENT" TO "PARKS AND RECREATION DEPARTMENT"; TO CHANGE THE TITLE OF "PARK FOREMAN' TO "PARK SUPERINTENDENT'; AMENDING SECTION 15-2, "FEES FOR SOCIAL SERVICES, CLASSES AND PROGRAMS" TO CHANGE "CITY RECREATION DIVISION AND SOCIAL SERVICES DEPARTMENT' TO "PARKS AND RECREATION DEPARTMENT"; AMENDING SECTION 15-26, "DIVISION OF PARKS AND DIVISION OF RECREATION" TO CHANGE "DIVISION OF PARKS AND DIVISION OF RECREATION" TO "PARKS AND RECREATION DEPARTMENT', TO PROVIDE FOR THE CREATION OF THE PARKS AND RECREATION DEPARTMENT AS A SEPARATE DEPARTMENT OF THE CITY, TO CHANGE "DIVISION' TO "DEPARTMENT", TO DELETE "PUBLIC WORKS", TO CHANGE "CITY COUNCIL" TO "CITY COMMISSION'; AMENDING SECTION 15-65, "DISPLAY" TO CHANGE "PARK FOREMAN' TO "PARK SUPERINTENDENT'; AMENDING SECTION 15-81, "CONTROL OF VEHICLES" TO CHANGE "PARK FOREMAN" TO "PARK SUPERINTENDENT'; AMENDING SECTION 15-84, "FIREARMS AND DANGEROUS INSTRUMENTS' TO DELETE "CITY EMPLOYEES AND PARK FOREMAN', TO REQUIRE AUTHORIZATION OF THE CITY MANAGER FOR FIREWORKS CONTRACTORS, TO CHANGE "OPERATIONS MANAGER" TO "DIRECTOR OF THE PARKS AND RECREATION DEPARTMENT'; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Ordinance 94-17, the Parks and Recreation Department was created to be responsible for the provision of leisure activities and social events to the CODING: Words in type are deletions from existing law; Words in underscored type are additions. 1 2 Temp. Ord. #1747 Revision #1 April 4, 1996 Revision #2 July 25, 1996 Revision #3 September 5, 1996 Revision #4 September 13, 1996 Revision #5 September 19, 1996 community and maintenance of park lands and recreation facilities and all other duties and functions normally associated with a municipality's parks and recreation department, and WHEREAS, numerous provisions of the City Code refer to the Parks and Recreation Department, as the Division of Parks and Recreation; and WHEREAS, the Division of Parks and Recreation has previously been incorporated within the Department of Public Works; and WHEREAS, it is beneficial to clarify the code provisions to make them consistent with Ordinance 94-17; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac that the Division of Parks and Recreation become a separate department, apart from the Department of Public Works of the City of Tamarac. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SEQTIQN L That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. Definitions. Department means the publie works parksregregtion department. Director means the director of PubFic works the parks and recreation_departmgnt. Park forems superinLenden means any employee of the city authorized to enforce this chapter within park boundaries. SECTION 3: That Section 15-2, "Fees for social services, classes and programs" is hereby amended as follows: Sec. 15-2. Fees for social services, classes and programs. (a) The city manager or his designee is authorized to establish fees wherever appropriate in writing for programs and classes sponsored or conducted by the eity Social Services Department and the Parks and Recreation Department. (b) All moneys collected by the Social Services Department and reere division Parks and Recrgation Depailment under the terms of this section shall be deposited into the appropriate account in the city's general operating fund. Division of parks and division of recreation ` - creatioM department. SECTION 5: That Section 15-65, "Display" is hereby amended as follows: Sec.15-65. Display. No person in a park shall refuse or fail to produce and exhibit any permit he claims to have upon the request of any enforcement officer, paid foreman or other authorized Parks Recreation employee who wishes to inspect the permit for the purpose of determining that the provisions of this chapter have been complied with. SECTIQN : That Section 15-81, "Control of vehicles" is hereby amended as follows: Sec.15-81. Control of vehicles. (1) No person shall park a vehicle on park property other than in area designated for parking that type of vehicle unless there is an emergency or unless directed to do otherwise by a law enforcement officer or a authorized Parks and Recreation employee fora. Parking shall conform to officially posted signs or markings unless other instructions are given by a law enforcement officer or a Parks and Recreation foi ertrrremployee.. SECTION 7; That Section 15-84, "Firearms and dangerous instruments" is hereby amended as follows: Sec. 15-84. Firearms and dangerous instruments. The South Florida Building Code and National Fire Prevention Association regulations shall be applied to assure that in such cases the fireworks are used in a safe manner. SECTION 8: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered, relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 9: All Ordinances or parts of Ordinances, and all Resolutions and parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 1 : If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
