AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ADDING ARTICLE VII, ENTITLED "BACKFLOW AND CROSS CONNECTION CONTROL" TO CHAPTER 22 OF THE TAMARAC CODE, ENTITLED "UTILITIES"; PROVIDING FOR THE PROTECTION OF THE PUBLIC POTABLE WATER DISTRIBUTION SYSTEM FROM CONTAMINATION OR POLLUTION DUE TO CROSS CONNECTION, BACKFLOW OR BACKSIPHONAGE OF CONTAMINANTS OR POLLUTANTS THROUGH THE WATER SERVICE CONNECTION; PROVIDING FOR DEFINITIONS; PROVIDING FOR ORDINANCE POLICY; PROVIDING FOR BACKFLOW PREVENTION DEVICES; PROVIDING FOR INSPECTION, TESTING AND MONITORING OF BACKFLOW PREVENTION DEVICES; PROVIDING FOR CERTIFICATION; PROVIDING FOR ENFORCEMENT; PROVIDING FOR FEES AND NOTIFICATION TO UTILITY CUSTOMERS; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac shall conform to the Department of Environmental Protection of the State of Florida, Chapter 62-555 as now written and as subsequently amended; and WHEREAS, the State Department of Environmental Protection in Chapter 62-555 of the Florida Administrative Code has promulgated certain regulations requiring CODING: Words in Arttek througit type are deletions from existing law: Words in underscored type are additions. Ord.1714 2 2/16/95 Rev. # 11 10/22/96 community water systems to establish a routine cross connection program for the purpose of detecting and preventing cross connections that create an imminent and subsequential danger to the public health by and from contamination due to cross connections; and WHEREAS, the South Florida Building Code, Section 4620, assigns certain responsibilities to the utility in prevention of backffow into the public water supply; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to protect the potable water supply of the City of Tamarac from the possibility of contamination or pollution; by adding Article VII entitled "Backflow and Cross Connection Control' to Chapter 22 of the Tamarac Code entitled "Utilities." NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SEQTI,QN 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. Short Title. n This article shall be known as "The City of Tamarac_Backflow and Cross Connection ControL_Qrdinance." SEC. 22-259. Applicability, 1) This Ordinance shall apply to the service area of the Tamarac, Florida water system. The purpose of this Ordinance is: M To protect the public potable water supply of Tamarac from the possibility of conta,mina#ign.-or pg1lution by isolating within the customer's system such contamination or pollutants that could backflow into the water system: and M To promote the elimination_ or potential of existing__cro connections, which could create backflow and backsi hp onage, between the customer's system and plumbing fixtures, and industrial piping system: and r To provide for the maintenance of a continuing program of cross connection control that will systematically and effectively preyo t�� a cgotamination or pollution of the Tamarac Water System, CODING: Words in struek through type are deletions from existing law: Words in undgraggted type are additions. SECTION 3: Specific authority to codify this ordinance in the Code of Ordinances of the City of Tamarac is hereby authorized and directed. SECTION 4; All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. If a section, sentence, clause or phrase of this Ordinance is held to be invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the validity of the remaining portions of this Ordinance.
