CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 0-96- Z
AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF TAMARAC, FLORIDA, AMENDING
CHAPTER 5 OF THE TAMARAC CODE ENTITLED
"BUILDING AND BUILDING REGULATIONS", BY
ADDING SECTION 5-1, ENTITLED, "BUILDING
DEPARTMENT PERMIT FEES" TO ARTICLE I, "IN
GENERAL"; PROVIDING FOR COMMISSION REVIEW
AND MODIFICATION OF BUILDING PERMIT FEES;
PROVIDING FOR COLLECTION OF FEES;
PROVIDING FOR CODIFICATION; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, F.S 553.79(1) and F.S. 553.80(1) authorize the collection of reasonable
building permit fees to enforce adopted building codes ; and
WHEREAS, §303.1 of the South Florida Building Code requires the payment of
building permit fees prior to issuance of building permits by the municipality; and
WHEREAS, Ordinance 0-95-10 passed and adopted on June 14, 1995, deleted
§§10-26(b)(1) and 10-26(b)(2) of the Tamarac Code which referenced Building Permit
Fees; and
WHEREAS, prior to the passage of Ordinance 0-95-10, the City Commission had
the power and duty to review, alter, add to, modify, deduct from or change any fee or
category on any scheduled building permit fee; and

WHEREAS, prior to the passage of Ordinance 0-95-10, the Tamarac Building
Department had the power to collect fees as established by the City Commission by
obtaining certain structural, plumbing, and electrical permits required to be issued prior to

initiation of construction, development or other improvement; and
WHEREAS, at this time the Tamarac Building Department has the power to collect
mechanical permit fees; and
WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the
best interest of the citizens and residents of the City of Tamarac that the Tamarac Code
be amended by adding Article I, Section 5-1, providing for the power and duty of the City
Commission to review, alter, add to, modify, deduct from or change any fee or categories
on any schedule building permit fees and instructing the Tamarac Building Department to
collect the fees for obtaining certain structural, plumbing, and electrical permits.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of the Ordinance
upon adoption hereof.

SECTION 2: Chapter 5, of the Tamarac Code is hereby amended by adding Article
I, "In General', Section 5-1 "Building Department Permit Fees" as follows:
Article I
Sec. 5-1.
In General
Building Department Permit Fees.

to modify, deduct from or in any other wchange any fees or any categories on aoy
schedule of building permit fees in exi nce or to be in exists a resolution adgpted
by the City Commi sign.
kW The Building Department of the City is instructed to gollect the fees a
established by resolution of the City Commission for the obtainii3q of certain struct I
plumbing. electrical and mechanical permits required issued prior initiation of
construction, development gr other im rovement .

SECTION 3: It is the intention of the City Commission and it is hereby
ordained that the provisions of this Ordinance shall become and be made a part of the
Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this
Ordinance may be renumbered, relettered and the word "Ordinance" may be changed to
"Section", "Article" or such other word or phrase in order to accomplish such intention.
SECTION 4: All Ordinances or parts of Ordinances, and all Resolutions or
parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict.
SECTION 5: If any provision of this Ordinance or the application thereof to
any person or circumstance is held invalid, such invalidity shall not affect other provisions
or applications of this Ordinance that can be given affect without the invalid provision or
application, and to this end the provisions of this Ordinance are declared to be severable.
