CITY OF TAMARAC, FLORIDA
ORDINANCE NO. 0-97
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA, AMENDING SECTION 22-30 OF
THE CODE OF ORDINANCES; PROVIDING FOR A WAIVER
OF THE PROHIBITION OF REMETERING OF WATER
SERVICE FOR THE PURPOSE OF ALLOCATION OF THE
DIRECT COST AMONG MULTIPLE USERS SUBJECT TO
THE TERMS OF APPLICABLE DEVELOPER'S
AGREEMENTS; PROVIDING FOR CONFLICT; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, water is a precious commodity and one that needs to be conserved, not
wasted; and
WHEREAS, it has been demonstrated over time that the best way to encourage
conservation is to separately meter and bill each water customer based on his/her actual
consumption; and
WHEREAS, it is sound public policy to encourage the separate metering of each
individual consumer's use for the purposes of accountability and conservation; and
WHEREAS, Section 22-30 of the Code of Ordinances currently prohibits the
remetering of water service to lessees, tenants, or others; and

WHEREAS, Section 22-30 was enacted to prevent profiteering by developers
through the resale of City provided water at rates higher than the developer was paying the
City; and
WHEREAS, this modification to Section 22-30 will encourage conservation while
preventing profiteering;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: That the foregoing whereas clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of this Ordinance
upon adoption hereof.
SECTION 2: Section 22-30, "Limitations of use" of the Tamarac Code is
hereby amended as follows:
(a) Service purchased from the City shall be used by the consumer only for the
purposes specified in the application for service and shall be for the
consumer's own use. The consumer shall not sell or othefwise dispe

SECTION 3: It is the intention of the City Commission and it is hereby
ordained that the provisions of this ordinance shall be made a part of the Code of
Ordinances of the City of Tamarac, Florida, and that Sections of this Ordinance may be
renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article"
or such other word or phrase in order to accomplish such intention.
SECTION 4: All Ordinances or parts of Ordinances in conflict herewith are
hereby repealed to the extent of such conflict.

any person or circumstance is held invalid, such invalidity shall not affect other provisions
or applications of this Ordinance that can be given affect without the invalid provision or
application, and to this end the provisions of this Ordinance are declared to be severable.
SECTION 6: This Ordinance shall become effective immediately upon
adoption.
