Ord. #1792 May 30, 1997 Revision #1: July 14, 1997 Revision #2: July 15, 1997 CITY OF TAMARAC ORDINANCE NO. 0-97--iy AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING SECTION 22-277 AND SECTION 22-279 OF THE CODE OF ORDINANCES; PROVIDING FOR THE ELIMINATION OF THE REQUIREMENT FOR A BUILDING PERMIT WHEN RECERTIFYING A BACKFLOW PREVENTION DEVICE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac approved Ordinance Number 0-96-19 on November 27, 1996 which provides for Backflow and Cross Connection Control; and WHEREAS, Ordinance Number 0-96-19 requires the recertification of the backflow prevention devices at all commercial, industrial and multi -family dwelling units; and WHEREAS, Ordinance Number 0-96-19 requires a plumbing permit to be CODING: Words instrdek through type are deletions from existing law; Words in underscored type are additions. 2 Temp. Ord. #1792 May 30, 1997 Revision #1: July 14, 1997 Revision #2: July 15, 1997 obtained by the customer or his representative prior to conducting the tests necessary to re -certify the viability of the backflow prevention device; and WHEREAS, the Utilities Department is the department responsible for overseeing the backflow prevention and cross connection program and needs to recover the costs of administering this program; and WHEREAS, the Building Department is not responsible for monitoring the backflow prevention devices once initially installed; and WHEREAS, the City of Tamarac desires to eliminate unnecessary procedural requirements on Tamarac businesses, unnecessary fees and unnecessary duplication of effort in the City government; and WHEREAS, the City Commission has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to amend Section 22-277 and Section 22- 279 of the Code of Ordinances. Ord. #1792 May 30, 1997 Revision #1: July 14, 1997 Revision #2: July 15, 1997 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. SECTION 2: Section 22-277. "Inspections and recertification" of the Tamarac Code is hereby amended as follows: (b) A plumbing permit must be obtained from the building department for all new installations and retrofits in accordance with this article. Ord. #1792 May 30, 1997 Revision #1: July 14, 1997 Revision #2: July 15, 1997 hereby amended as follows: (a) Permits for new installation, retrofitting and certification and feeeFtifiestiem of backflow devices/assemblies as required by this ordinance must be obtained from the building department by a master plumber in accordance with Chapter 4620 of the South Florida Building Code. The applicant shall pay the building permit fee in effect at the time of issuance of the permit. However, the utilities department shall install, certify and recertify all backflow device on city facilities without the requirements for permits or fees from the building department as allowed by state law (F.S. § 489.103). (d) A Utilities Backflow Fee must be paid by the owner at the time of recertification. The fee shall beqet by Resolution. SECTI N 4: It is the intention of the City Commission and it is hereby ordained that the provisions of this ordinance shall be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION_ All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid CODING: Words in struelt type are deletions from existing law; Words in underscored type are additions.
