Reso. #1798 8/19/97 1 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-97---1; AN ORDINANCE OF THE CITY OF TAMARAC, FLORIDA, AMENDING SECTION 6-37 OF THE TAMARAC CITY CODE PROVIDING FOR AN INCREASED SERVICE CHARGE FROM $25.00 TO $35.00 FOR PROCESSING REQUESTS FOR LIEN INFORMATION; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CITY CODE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 6-37 of the Code of Ordinances authorizes the City to obtain a fee of $25.00 from individuals requesting an accounting of the amounts of outstanding city liens; and WHEREAS, David M. Griffith and Associates was hired to conduct a user fee study and determined that a fee increase was necessary to sufficiently cover the administrative costs involved; and WHEREAS, the City Manager and City Clerk recommend increasing this fee from $25.00 to $35.00 per request; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac to increase this fee for lien search requests. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. Ord. #,1M 8/19/97 1 1 1 SECTION 2: Section 6-37 of the Tamarac Code is hereby amended as follows: Sec. 6-37. Requests for information concerning outstanding city liens. Whenever the City receives a request for an accounting of the amounts of any outstanding City liens, a minimum service fee of $25.00 $35.00 per request shall be charged to the person making the request. Additional charges at the rate of $25.00 $35,00 per hour shall be charged if the request requires more than one (1) hour of clerical time. SECTION 3: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: All Ordinances or parts of Ordinances, and Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
