Ord. 1802 Page 1 9/4/97 Revision #5 9/23/97 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-97-jD AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 7 " FIRE PREVENTION AND PROTECTION", ADDING NEW SECTION 7-30 "FIRE ALARMS", PROVIDING FOR ACCOUNTABILITY FOR REPAIR AND MAINTENANCE OF FIRE ALARMS; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Tamarac Fire Rescue Department responds to calls for assistance, including fire alarms; and WHEREAS, Tamarac Fire Rescue responds to over 600 false alarms each year, most of which are caused by fire alarm systems malfunctioning or improperly designed fire alarm systems and are preventable; and WHEREAS, responses to false alarms may cause delays in responding to a real emergency, endangering lives and property; and WHEREAS, the owners of the fire alarm systems should be accountable for having properly operating systems; and WHEREAS, the Fire Chief recommends approval of a fire alarm ordinance; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the Coding: Words in StFUG14 thFOW04 are deletions from existing law; Words in underscored type are additions. Ord. 1802 Page 2 9/4/97 Revision #5 9/23/97 best interest of the citizens and residents of the City of Tamarac that Chapter 7 of the City Code be amended by adding Sec. 7-30, "Fire Alarms" to provide for accountability, repair, and maintenance of fire alarms. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA- SECTION 1: That the foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. SECTION 2: Chapter 7 of the Tamarac Code is amended as follows: Sec. 7-30 Fire Alarms (A) Notice of Existence of Fire_Alarm_System 1) A fire alarm system is defined as a system or portion of a combination system consisting of components and circuits arranged to monitor and annunciate the status of fire alarm or supervisory signal -initiating devices and to initiate the appropriate response to those sianals. Smoke detectors installed by themselves do not constitute a fire alarm system. (2)The Fire Prevention Bureau shall be notified of any fire alarm system within the City prior to the system being activated. Such notice shall be through The "Notice of a Fire Alarm," completed by the owner and returned to the Fire Prevention Bureau prior to the system being activated. (3) When any of the information required in The "Notice of Fire Alarm" subsection has changed, it shall be reported to the Fire Prevention Bureau by the Coding: Words in struek thFOU914 are deletions from existing law; Words in underscored type are additions. (4) It shall be the responsibility of the company installing any fire alarm system to provide the system owner with a copy of the most current City Alarm ordinance, a "Record of Completion" form and a completed copv of NFPA 72(1996) "Inspection and Testing Form." (B) Responsibility for fire alarm systems. (1) The owner of the premises in which the fire alarm system is installed is responsible for the fire., alarm_ system. If there_ is no evidence of fire the Fire Rescue Department will make every effort to contact the owner of the premises, or the owner's agents identified in the "Notice of a Fire Alarm." If the Fire Rescue Department is unable to contact said owner, or the owner's agents, and they are not able to respond to the address within a reasonable time frame, upon the discretion of the Fire Rescue Department personnel on scene, to determine if a fire exists or the system is malfunctioning, then the premises may be forcibly entered. (2) In the event of a fire alarm activation as a result of a fire alarm malfunction or inadequate system design, the owner will be served a notice of fire alarm activation. The owner is reauired to return a completed "Affidavit of Service/Repair" within fifteen (15) days of said alarm activation which can verify that the fire alarm system has been examined by a fire alarm technician and that an attempt has been made to identify and correct any defect of design, installation or operation of the fire alarm system. (3) Failure to return an "Affidavit of Service/Repair, shall be deem as evidence of non repair. All systems not repaired within fifteen days or any system with more than three false alarms within a six-month period shall be reported to Code Enforcement for compliance. SECTION 3: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Coding: Words in MFUGk thFeY914 are deletions from existing law; Words in underscored type are additions. Ord. 1802 Page 4 9/4/97 Revision #5 9/23/97 Ordinance may be renumbered, relettered and the word "Ordinance" may be changed to "Section," "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: All Ordinances or parts of Ordinances, and all Resolutions and parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
