Ord. 1803 Page 1 9/4/97 Revision #6 9/26/97 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-97- 02 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 7 " FIRE PREVENTION AND PROTECTION", SECTION 7-29, "FIRE SERVICE FEES", PROVIDING FOR THE ABILITY OF THE FIRE RESCUE DEPARTMENT TO RECOVER EXPENSES INCURRED IN THE PROVISION OF SERVICES BY THE FIRE RESCUE DEPARTMENT; AND TO HAVE THE FEES ESTABLISHED BY RESOLUTION OF THE CITY COMMISSION; DELETING SECTION 7-53 "FIRE INSPECTION FEES"; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Tamarac provides both emergency and non -emergency services including but not limited to fire suppression, advanced life support transport, emergency preparedness education, response and recovery, fire inspections, plan reviews, and public education; and WHEREAS, the responsibilities, authorities, funding sources, and community requirements have changed because of changes in demographics and statutes ; and WHEREAS, medical treatment and transportation services may be provided by the Tamarac Fire Rescue Department and the cost for each patient transported should be established at a reasonable and competitive rate, and Coding: Words in StF Gk thFOU014 are deletions from existing law; Words in underscored type are additions. Temp. Ord. 1803 Page 2 9/4/97 Revision #6 9/26/97 WHEREAS, the Fire Rescue Department conducts plan reviews and annual building inspections. The size and complexity of the plans and buildings are indicators of the effort and time needed to complete the inspections; and WHEREAS, the Fire Rescue Department also responds to fire alarm activations, many of which are false alarms. These calls may delay the response to actual emergencies and increase the Fire Rescue service costs to the city; and WHEREAS, other requests for assistance can be varied and these costs should be based on time and materials, and WHEREAS, a fair portion of the costs for these services should be paid by those using the services; and WHEREAS, the Fire Chief recommends approval for the creation of fire service fees; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac that Chapter 7 of the Tamarac Code be revised to expand and redefine fire service fees. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. coding: Words in rt.61Gk thFeU^h are deletions from existing law; Words in underscored type are additions. Temp. Ord. 1803 Page 3 9/4/97 Revision #6 9/26/97 SECTION 2: Chapter 7 of the Tamarac Code is amended as follows: Sec. 7-29. Fire service fees. (A) Medical treatment and transport: The Fire Rescue Department is authorized to require payment for medical treatment and transport. Advanced Life Support �ALSJ shall be the minimum level of transport service provided by the CITY. ALS is the level of care provided by a paramedic. Fee 6ehedules 6hail be kept an file R the B Fire Inspections: The Fire Rescue Department is authorized to re uire payment for fire inspection and plan review services. (C) Special Hazards and Hazardous Materials: The Fire Rescue Department is authorized to require payment forspecial hazards and hazardous materials responses. Special hazards are defined as any response requiring morespecialized a ui ment and personnel than are readily available within the City of Tamarac or hazards of an extreme or uni ue nature. The rates and charges applicable to special hazards and hazardous materials responses shall be based on time and materials beyond the usual. (D) Public Education: The Fire Rescue Department is authorized to require payment to cover the cost of educational materials equipment and instructors. E Special Details/Fire Watch: Cost of fire watches required by the Fire Chief andspecial details both fire watches and medical standbys, requested by individuals groups, or organizations shall be as provided by resolution of the City Commission. The rates and charges applicable to Special Details/Fire Watches shall be based on time and materials. (F)The rates charges and fines applicable for all fire services shall be established by resolution of the City Commission. The recipients of services are responsible for payment of fees. Ord. 1803 Page 5 9/4/97 Revision #6 9/26/97 SECTION 3: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered, relettered and the word "Ordinance" may be changed to "Section," "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: All Ordinances or parts of Ordinances, and all Resolutions and parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid Coding: Words in stmrk thFougli are deletions from existing law; Words in underscored type are additions. 11 1 Temp.
