Ord. #1804 1 9/17/97 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-97- Z2�, AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 7 OF THE TAMARAC CODE, ENTITLED "FIRE PREVENTION AND PROTECTION", SECTION 7-28 "FIRE CHIEF", BY AMENDING RESPONSIBILITIES OF THE FIRE RESCUE DEPARTMENT DIRECTOR/FIRE CHIEF; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the responsibilities of the Fire Rescue Department have expanded and increased; and WHEREAS, the Tamarac Code the Fire Rescue Department Director/Fire Chief's responsibilities have expanded and increased along with the department's growth; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac that the responsibilities of the Fire Rescue Department Director/Fire Chief be revised to reflect the growth and expansion of the Fire Rescue Department. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. SECTION 2: Chapter 7 of the Tamarac Code, entitled "Fire Prevention and CODING: Words in stF & +hFa g1 type are deletions from existing law; Words in underscored type are additions. Temp. Ord. #1804 2 9/17/97 Protection" is amended as follows: Sec. 7-28. Fire rescue director-- Fire chief. (a) The Director of the Fire Rescue Department, henceforth also known as the fire chief shall be appointed by the city manager and shall be subject to removal by the city manager. The fire chief shall be technically qualified by training and experience and shall have the ability to command people. The fire chief shall be held accountable to the city manager only and shall make written and verbal reports therete as the city manager may require and direct. (b)(2) The fire chief shall have command of all fire fighting personnel. The officers and employees of the fire rescue department shall be under the directions and control of the fire chief. The fire chief shall determine the number and kind of companies of which the fire department is to be composed and shall determine the response of such companies to alarms. (3) The fire chief shall inspect, or cause to be inspected, any and all buildings which legally may be inspected, and shall have the right to enter all buildings and premises at all reasonable hours for the purposes of making inspections, and to serve written notice upon the owner or occupant thereof, to abate, within a time specified, any and all fire hazards which may be found. Any persons so served with a notice to abate a hazard or hazards shall comply therewith and allow appropriate reins ections to confirm such compliance. . (4) The fire chief is empowered to summon to court any and all persons who may deny him the right of entry at a reasonable hour for the purposes of making a fire inspection and also to summon to court or the city code enforcement board any and all persons who have not abated a violation of a city or state fire code within the time specified in the notice provided or for repeated violations of the same code section. Ord. #1804 9/17/97 assistance. The fire chief shall provide appropriate response based upon the nature of the emergency. Responses shall be made to all reguests for emergency medical aid fires hazards disasters and any other calls for emergency assistance. (56) The fire chief shall investigate or cause to be investigated any and all fires and shall file a report of such investigation. The fire chief shall assist other proper authorities in any investigation of fires. (67) The fire chief shall compile and record or cause to be compiled and recorded all statistics and information which may be relevant to the prevention of fire and suppression of the crime of arson within the city. SECTION 4: All Ordinances or parts of Ordinances, and Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
