Ord. # 1816 Page 1 January 16, 1998 Revision #3 January 21, 1998 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-98- .3 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 22, UTILITIES, ARTICLE III, RATES AND CHARGES AND BILLING PROCEDURE, SECTION 22-127, DISCONTINUANCE OF SERVICE AND DISCONNECTION OF PREMISES FROM SYSTEM FOR NONPAYMENT; DELINQUENCY CHARGE OF THE TAMARAC CODE TO CHANGE THE NUMBER OF DAYS AVAILABLE FOR PAYMENT OF UTILITY BILLS BEFORE RECEIVING NOTIFICATION OF DISCONTINUATION OF SERVICE FROM THIRTY (30) DAYS TO NOT LESS THAN TWENTY-FIVE (25) DAYS; PROVIDING FOR CODIFICATION; PROVIDING FOR REPEALER; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, customers who have not fully paid their balance within 30 days receive a notice of discontinuation on their next utility bill stating that payment must be received by 45 days or service shall be disconnected as per Section 22-127 (a) of the City Code; and WHEREAS, the requirements of this notification, contained on utility bills, means that utility bills cannot be mailed prior to the 31" day but often are mailed later than 31 days due to weekends and holidays; and CODING: W9F& iF1 StFUGli thFeugh type are deletions from existing law; Words in underscored type are additions. Ord. # 1816 Page 2 January 16, 1998 Revision #3 January 21, 1998 WHEREAS, billing cycles are intended to equalize workload throughout the month by maintaining billing date consistency between months; and WHEREAS, utility bills mailed 31 days or later can cause billing cycles to move to a date later in the following month; and WHEREAS, over time, billing cycles have become closer together instead of being maintained at an even distribution throughout each month; and WHEREAS, even distribution of work throughout the month is essential to providing good customer service, timely processing of payments and a higher quality of work; and WHEREAS, operational flexibility is essential to maintaining an evenly distributed workload throughout a month; and WHEREAS, operational flexibility is achieved by changing the number of days available from thirty (30) days to not less than twenty-five (25) days for payment of utility bills before receiving notification of discontinuation of service; and WHEREAS, the City Manager and Assistant City Manager/Director of Finance recommend approval; and CODING: Atr, gli thFeugh type are deletions from existing law; Words in underscored type are additions. Ord. #1808 Page 3 Revision #2: 12/4/97 SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. Ord. # 1816 Page 3 January 16, 1998 Revision #3 January 21, 1998 WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interest of the citizens and residents of the City of Tamarac that the number of days available before receiving notification of discontinuation be changed from thirty (30) days to not less than twenty-five (25) days for payment of utility bills in order to maintain consistent and evenly distributed billing cycles. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. SECTION 2: Chapter 22, Article III, Section 22-127, of the Code of Ordinances of the City of Tamarac, Florida, is hereby amended as follows: Section 22-127. Discontinuance of service and disconnection of premises from system for nonpayment; delinquency charge. Ord. # 1816 Page 4 January 16, 1998 Revision #3 January 21, 1998 W If the service bill or other charge is not paid within twenty-five (25) #*ty (39) calendar days after the date rendered, the city will subsequently mail a notice to the party on record. The notice, which may take any written form, will inform the consumer that if payment is not received within forty-five (45) days from the original rendering date, service shall be discontinued. SECTION 3: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
