ORDINANCE NO, 0-98- 7
AN ORDINANCE OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA,
AMENDING CHAPTER 9 ENTITLED, "HEALTH,
SANITATION AND NUISANCES", BY CREATING
ARTICLE IV ENTITLED, "THE LOCAL HOUSING
ASSISTANCE PROGRAM", WHICH PROVIDES
FOR THE ESTABLISHMENT OF A LOCAL
HOUSING ASSISTANCE PROGRAM
PURSUANT TO THE REQUIREMENTS OF THE
STATE HOUSING INITIATIVES PARTNERSHIP
ACT; PROVIDING FOR DEFINITIONS;
PROVIDING FOR LEGISLATIVE INTENT;
PROVIDING FOR THE ESTABLISHMENT OF A
LOCAL HOUSING ASSISTANCE PROGRAM TO
BE ADMINISTERED BY THE CITY OF
TAMARAC; PROVIDING FOR THE
IMPLEMENTATION AND ADMINISTRATION OF
THE PROGRAM AND PROVIDING FOR THE
CREATION OF AN AFFORDABLE HOUSING
ASSISTANCE TRUST FUND; PROVIDING FOR
THE ESTABLISHMENT OF AN AFFORDABLE
HOUSING ADVISORY COMMITTEE PURSUANT
TO THE REQUIREMENTS OF THE ACT;
PROVIDING FOR THE CREATION AND
APPROVAL OF AN AFFORDABLE HOUSING
INCENTIVE PLAN; PROVIDING FOR
CODIFICATION; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac wishes to provide for the housing needs of its

citizens, and to promote efficient location, design, and provision of affordable housing; and
WHEREAS, the State Housing Initiatives Partnership Act ("Act") provides for the
establishment of local housing assistance programs; and
WHEREAS, the City of Tamarac desires to establish a Local Housing Assistance
Program; and
WHEREAS, the Director of Community Development recommends approval to
establish a Local Housing Assistance Program; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of the citizens and residents of the City of Tamarac to amend Chapter
9 entitled, "Health, Sanitation and Nuisances", by creating Article IV entitled, "The Local
Housing Assistance Program", which provides for the establishment of a Local Housing
Assistance Program pursuant to the requirements of the State Housing Initiatives
Partnership Act.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of the Ordinance
upon adoption hereof.

SECTION 2:
Chapter 9 entitled, "Health, Sanitation and Nuisances", is hereby amended by
creating Article IV entitled "The Local Housing Assistance Program".
9-130 DEFINITIONS
For the purposes of this Ordinance, the definitions contained in the State
Housing Partnership Act ("Act"), and Chapter 91-37, Florida_ Administrative
Code as they may be amended from time to time are adopted herein b
reference.
9-131 LEGISLATIVE INTENT
The purposes of this Ordinance are to implement the Act includin
without limitations the following:
a To increase the availability of affordable housing by combining local
resources and cost saving measures using a local housing
artnershi s as applicable, and by using --private and public funds
to reduce the cost of housin
(b) To promote more compact urban development, and to assist in
achieving the growth management goals containedin the adopted

Local Comprehensive Plan by allowing more efficient use of land so
as to provide housing units that are more affordable;
To establish a strona sense of communitv throuah increased social
and economic integration;
(d) To build the organizational and technical capacity of community -
based oraanizations in the oroduction of affordable housi
(e) To promote innovative design of eligible housing, and its supporting
infrastructure, to provide for cost savings in the provision of such
housing; and
(fl To promote expedited permit processing systems for affordable
housing: and
To promote review 2rocedures for plan grovision that impacts
affordable housing.
9-132 ESTABLISHMENT OF LOCAL HOUSING ASSISTANCE PROGRAM
(a) There is hereby created and established a Local Housing Assistance
Program ("Program") . by the City, to be implemented and
administered by the Cif.
(b) The City shall implement the Program, within the City, consistent with
the requirements of the Act. The strategies of the Program _will be

outlined in the Cit 's SHIP Housing Assistance Plan.
9-133 ESTABLISHMENT OF AFFORDABLE HOUSING ASSISTANCE TRUST
(a) Pursuant to the requirements of the Act, the City agrees to establish
an Affordable Housing Assistance Trust Fund "Fund" within the
official and fiscal accounting records of the City_._. All monies
deposited in the Fund shall be subject to the requirements of the Act,
and the City ordinance establishing the Fund.
(b) The City shall cause the Fund to be audited, and shall report the
results of such audit as required by the Act.
9-134 ESTABLISHMENT OF AFFORDABLE HOUSING ADVISORY COMMITTEE
Pursuant to the requirements of the Act there is hereby created and
established an Affordable Housing Advisory Committee ("Committee').
Composition of the Committee shall be as required by the Act. Members
of the Committee shall be appointed by Resolution.
9-135 REVIEW AND APPROVAL OF THE AFFORDABLE HOUSING INCENTIVE PLAN
(a) Pursuant to the requirements of the Act, within thirty (30) days of
their receil2t from the Committee the City shall forward the
Committee's recommendation to the Cily Commission for review and
consideration. Following the review of such recommendations, the

City shall, pursuant to the requirements of the Act, adopt an
Affordable Housing Incentive Plan "Incentive Plan").
(b) Upon adoption of the Incentive Plan the City shall forward, or cause
to be forwarded a copy of the adopted Incentive Plan to appropriate
agencies pursuant to the re uirements of the Act.
SECTION 3: CODIFICATION
It is the intention of the City Commission and it is hereby ordained that
the provisions of this Ordinance shall become and be made a part of the Code of
Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance
may be renumbered or relettered and the word "Ordinance" may be changed to
"Section", "Article" or such other word or phrase in order to accomplish such
intention.

SECTION 6. EFFECTIVE DATE
In accordance with the requirements of this Act, this Ordinance shall
become effective thirty (30) days following its adoption.
