ORDINANCE NO. 0-98---q-
AN ORDINANCE OF THE CITY COMMISSION
OF THE CITY OF TAMARAC, FLORIDA,
AMENDING CHAPTER 9, "HEALTH,
SANITATION, AND NUISANCES", ARTICLE IV
"THE LOCAL HOUSING ASSISTANCE
PROGRAM"; SECTION 9-134 ENTITLED,
"ESTABLISHMENT OF AFFORDABLE
HOUSING ADVISORY COMMITTEE", BY
DELETING A MINOR PORTION OF THE TEXT;
AND AMENDING SECTION 9-135, "REVIEW
AND APPROVAL OF THE AFFORDABLE
HOUSING INCENTIVE PLAN" BY DELETING A
MINOR PORTION OF THE TEXT IN
SUBSECTION (a), CREATING SUBSECTION 9-
135(c) TO PROVIDE FOR AMENDMENT OF
THE PLAN WITHIN TWELVE (12) MONTHS,
PROVIDING FOR CODIFICATION; PROVIDING
FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.

WHEREAS, the State Housing Initiatives Partnership Act ("Act") provides for the
establishment of local housing assistance programs; and
WHEREAS, the City of Tamarac desires its State Housing Initiatives Partnership
(SHIP) Grant Application, containing the City's Local Housing Assistance Program, to be
in complete compliance with the State's SHIP Program application requirements; and
WHEREAS, the Director of Community Development recommends approval; and

WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interests of its citizens and residents to amend the language of the Local Housing
Assistance Program.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being true and correct and are hereby made a specific part of the Ordinance
upon adoption hereof.
SECTION 2: Chapter 9, "Health, Sanitation and Nuisances", Article IV, "The
Local Housing Assistance Program" Section 9-134, Establishment of Affordable Housing
Advisory Committee, is hereby amended as follows:
9-134 ESTABLISHMENT OF AFFORDABLE HOUSING ADVISORY COMMITTEE

Affordable Housing Advisory Committee ("Committee"). Composition of the Committee
shall be as required by the Act. Members of the Committee shall be appointed by
Resolution pursuant to the requirements of the Ordinance within thirty (30) days of the
effective date of this Ordinance.

SECTION 3: Chapter 9, Article IV, "Local Housing Assistance Program", Section
9-135 "Review and Approval of the Affordable Housing Incentive", is amended as follows:
9-135 REVIEW AND APPROVAL OF THE AFFORDABLE HOUSING INCENTIVE PLAN

the Committee, the City shall forward the Committee's recommendation to the City
Commission for review and consideration. Following the review of such recommendations,
the City shall, pursuant to the requirements of the Act, adopt an Affordable Housing
Incentive Plan ("Incentive Plan")
c Within twelve 12 months after the original adoption of the Local Housing Assistance
Plan the City shall amend the Ian to include local housing -incentive strategies as defined
in Florida State Statute Section 420.9071_(15).

SECTION 4: It is the intention of the City Commission and it is hereby
ordained that the provisions of this Ordinance shall become and be made a part of the
Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this
Ordinance may be renumbered, relettered and the word "Ordinance" may be changed to
"Section", "Article" or such other word or phrase in order to accomplish such intention.
SECTION 5: All Ordinance or parts of Ordinances, and all Resolutions or
parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict.
SECTION 6: If any provision of this Ordinance or the application thereof to
any person or circumstance is held invalid, such invalidity shall not affect other provisions
or applications of this Ordinance that can be given affect without the invalid provision or
application, and to this end the provisions of this Ordinance are declared to be severable.
