Ord. #1838 Page 1 of 3 1 /22/99 Rev. #1-2/2/99 ORDINANCE NO. 0-99- O AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 6, FINANCE AND TAXATION, ARTICLE II, FEES AND FUNDS, OF THE TAMARAC CODE, BY ADDING SECTION 6-40, ENTITLED PASSPORT EXECUTION FEES; PROVIDING FOR ADOPTION AND ACCEPTANCE OF EXECUTION FEES AS CURRENTLY ESTABLISHED AND SUBSEQUENTLY AMENDED BY THE UNITED STATES STATE DEPARTMENT, PASSPORT AGENCY; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac desired to participate in the passport application acceptance process to provide passport services to the residents of Tamarac and surrounding areas, and WHEREAS, on October 14-15, 1998, the staff of the City Clerk's office received training provided by the United States Department of State, Passport Agency, in order to provide passport application acceptance services to the residents of Tamarac and surrounding areas; and WHEREAS, in accordance with the United States Department of State, Passport fees and execution fees are standardized, as shown in Exhibit "'I", attached hereto and made a part hereof; and WHEREAS, the City Commission of the City of Tamarac deems it to be in the best interests of the residents and citizens of the City of Tamarac and surrounding areas to participate in providing passport application acceptance services to the residents of Tamarac and surrounding areas and to charge such fees as set forth by the United States State Department, Passport Agency. Ord. #1838 Page 2of3 1 /22/99 Rev. #1-2/2/99 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. SECTION 2: That Chapter 6 of the Tamarac Code be amended as follows by adding Section 6-40, "Passport Execution Fees", in accordance with the United States State Department, Passport Agency fee schedule, attached hereto as Exhibit 1": Sec. 6-40, Passport Execution Fees. 1. In accordance with the fee structure established by the United States State Department, Passport Agency, for processing passport applications, the City Manager or designee is authorized to collect execution fees through the City Clerk's office in connection with the processing of passport applications as currently established and subsequently amended by the United States State Department, Passport Agency. 2. All execution fees collected by the City Clerk's office for processing_ passport applications shall be deposited into the appropriate account in the city's general operating fund. 3. The City Manager or designee is authorized to waive payment of execution fees. SECTION 3: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" CODING: Words in 64welk thFeUgh type are deletions from existing law; Words in underscored type are additions Temp. SECTION 4: All ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. INTEROFFICE MEMORANDUM CITY CLERK TO: City Manager DATE: 27 JANUARY 1999 FROM: City Clerk 6a-4�Le Recommendation: RE: Passport Execution Fees It is recommended that the City Commission adopt Temporary Ordinance #1838, an Ordinance of the City Commission of the City of Tamarac, Florida, amending Chapter 6, Finance and Taxation, Article II, Fees and Funds, of the Tamarac Code, by adding Section 6- 40, entitled Passport Execution Fees; providing for adoption and acceptance of execution fees as currently established and subsequently amended by the United States State Department, Passport Agency; providing for conflicts; providing for severability; providing for codification; and providing for an effective date. Issue: It has come to my attention that the Tamarac Code may need to be amended to authorize the City to collect these particular fees. I have attached A temporary ordinance amending Chapter 6 of the Tamarac Code, by adding a section entitled Passport Execution Fees for this service, as stipulated in the document provided by the United States State Department, Passport Division. Background: In September 1998, the City Commission expressed a desire to participate in the passport application process, in order to provide passport services to the residents of Tamarac and surrounding areas. In accordance with the Commission's desire to participate in this process, the City Clerk's staff underwent training on October 18-19, 1998, to learn the procedures necessary to process passport applications. At the time of the training sessions, information pertinent to the processing of the applications as well as the collection of fees was given to the staff. (See Passport Fees, attached.) The fees are set by the United States State Department, and the execution fees collected to date have been deposited daily into account 001-0000-341.90-35, set up by the Finance Department. CG/cg Attachments 0 C] C] PASSPORT AGENT'S REFERENCE GUIDE Passport Services Chapter 8 Fees 1- A. Passport Fee and Execution Fee. The Passport Agent Collects the required fees when the application is executed. The passport fee for a DSP-1 1 Passport Application is $25 for passports issued to persons under 16 years of age and $45 for passports issued to persons 16 years old or older. The execution fee is $15 for both minors and adults. 1. B. Federal Officials. Both the passport fee and the execution fee are collected for a regular (fee) DSP-11 Passport Application executed before a Passport Agent, postal employee, clerk of a Federal court, or other authorized official and submitted to Passport Services. The ' applicant may pay both fees with one check or money order. ( At present, federal officials do not collect either fee for no -fee passport applications.) 1. C. Stafa and Local Officials. State, county or municipal officials collect the execution fee for executing both fee and no -fee passport applications. The acceptance office retains the execution fees, which are disposed of as state and local laws prescribe. Customers should pay the execution fee and the passport fee separately to non -Federal officials. (Note: All no -fee passports are now issued by the Special Issuance Agency in Washington, D.C. See page 68 for the address.) 1 • D. Special Postal Services. A customer who wants the passport returned other than by First Class Mail may include a postage -paid, pre -addressed envelope with the application. (Please note: The address on the mailer must match the mailing address on the application.) They may request any one or a combination of special postal services by providing an envelope with sufficient postage. If services are to be billed to an account number or in some other fashion, they should check with the carrier to confirm arrangements before submitting the application. Passports for families or other groups will be returned in separate envelopes. Therefore, families or groups must submit a separate postage -paid, pre -addressed envelope for each passport applicant. All special fees and other arrangements for mailing are the sole responsibility of the customer. 1- E. Expedite Fee. A customer, who requests rush processing of a passport application, due to imminent departure or visa processing time requirements, must pay a $35 Expedite Fee. The Passport Agency will process the application within three business days of receiving the application at the Agency. A single check or money order may cover both the Expedite Fee and other fees. 1. F. Finn -Time Documentation of Persons Born Outside the U.S. (Refer to Chapter 3, section 1A, for definition of U.S.) Persons born outside the U.S. must present, as evidence of their U.S. citizenship, either their own previously issued U.S. Passport, their own U.S- Certificate of Naturalization, their own U.S. Certificate of Citizenship, or their own Report of Birth Abroad. If unable to present the stated docGmentation, an adjudication fee of $100 will be charged, This fee is in addition to other applicable passport fees. 2. Currency ("No Cash-). Please do not send currency received for the Passport fee, execution fee, or postage through the mails. Passport Services cannot be responsible for currency, or any other form of payment, lost in transit. 3. A. Acceptable Forms of Payment. Payment of fees must be in one of the following forms: • personal check; • bank draft; • cashier's draft; • certified check; • Clerk of Court check; • traveler's check; • postal money order; • commercial money order (American Express Co., etc.): or • foreign check payable in U.S, currency through a U.S. bank. Checks or drafts should be made payable to the U.S. Department of State and must not be more than 60 days old. (Post-dated checks or Revi••d 01/21/98 k/ 37 Chapter 8 Fees drafts are not acceptable.) A check must be drawn and signed in ink, be preprinted to show the name and location (city and state) of the bank on which it is drawn, and include Magnetic Ink Character Recognition. The customer's date of birth should be noted on all personal checks. If the name is not preprinted on the check, ask the customer to print it as well as the date of birth. If the check is drawn by someone other than the applicant, note the applicant's name and date of birth on the check. If a check covers two or more applications, note the name and date of birth of each customer on the check. 3. B. Unacceptable Forms of Payment. Stamps, universal or counter checks, "scratched" checks (checks drawn against a bank other than the preprinted bank), or other forms of payment that do not meet the criteria stated above are not acceptable.
