Ord.#1835 Page 1 January 29, 1999 Rev. #1 February 10, 1999 ORDINANCE NO. 0-99-� AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING TAMARAC CODE, CHAPTER 6 "FINANCE AND TAXATION," ARTICLE V "PURCHASING PROCEDURES," SECTION 6- 145(1), "PURCHASING OFFICER," PROVIDING THAT THE PURCHASING OFFICER SHALL ARRANGE FOR CONTRACTED SERVICES, AND SECTION 6-146(C), "SCOPE OF PURCHASING AUTHORITY," DELEGATING AUTHORITY TO THE PURCHASING OFFICER TO EXECUTE CONTRACTS, AGREEMENTS AND OTHER INSTRUMENTS UNDER $10,000; PROVIDING FOR CODIFICATION, PROVIDING FOR REPEALER, PROVIDING FOR SEVERABILITY, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Charter Section 12.09 requires all contracts or other instruments to which the city is a party shall be executed by the Mayor and attested by the City Manager, except where the execution of short-term leases and instruments are delegated by ordinance or resolution to other officials; and WHEREAS, Charter Section 5.04(e) provides that the City Manager shall execute contracts on behalf of the City pursuant to appropriate ordinances, resolutions and directions of the Commission; and Charter Section 5.04(I) provides that the heads of each department, division or agency shall be responsible to the Manager for the operation thereof and shall perform such duties and have such powers as may be prescribed; and CODING: Words in S#U& through type are deletions from existing law; Words in underscored type are additions. Ord.#1835 Page 2 January 29, 1999 Rev. #1 February 10, 1999 WHEREAS, it is necessary for the City of Tamarac to enter into a wide variety of contracts in conducting City business; and WHEREAS, many standard and repetitive type contracts, including but not limited to, equipment maintenance agreements, one time instructors for various recreational programs, and license agreements, are for small dollar amounts; and WHEREAS, in order to enhance departmental productivity, efficiency, and expediency, it is necessary for the authority to arrange for contracted services and to execute contracts, agreements and other instruments under $10,000, to be delegated to the Purchasing/Contracts Manager pursuant to Charter Sections 5.04 and 12.09; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to amend Chapter 6, Article V, Sections 6-145(1) and 6-146(c), by delegating authority to the Purchasing/Contracts Manager to arrange for contracted services and to execute certain contracts and other instruments under $10,000. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1. That the foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. That Article V, Section 6-145 is hereby amended as follows: Section 6-145. Purchasing Officer. The city purchasing officer shall be the head and have general supervision of the division of purchasing. The purchasing officer shall perform all duties required by directive of the city manager and shall have the powers and duties prescribed by this article. The purchasing officer shall: (1) Arrange for purchases of all supplies, materials, equipment, and contracted services required by any office, department or agency of the city government; (2) Transfer to or between offices, departments or agencies surplus, obsolete or unused supplies, materials and equipment. Section 3. That Article V, Section 6-146 is hereby amended as follows: Section 6-146. Scope of Purchasing Authority. (c) In addition to the purchasing authority conferred in subsection (a) above, and in addition to any other powers and duties conferred by this article, the purchasing officer shall: (20) Have the authority, subject to the approval of the city manager, to execute contracts, agreements and other instruments under 10 000. Codification: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered, relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. Section 5. That all Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 6. That if any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. Section 7. That the provisions of this Ordinance shall become effective immediately upon its passage and adoption.
