Ord. # 1854 6/17/99 Rev. #1 9/20/99 Rev. #2 10/25/99 Page 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-99- aZ/ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING ARTICLE IV, SECTION 4.08, OF THE TAMARAC CHARTER ENTITLED "BOARDS AND ADVISORY GROUPS" BY CHANGING THE PROCEDURE FOR CREATING CERTAIN BOARDS, AUTHORITIES AND AGENCIES FROM CREATION BY ORDINANCE TO CREATION BY RESOLUTION; PROVIDING THAT IF THE AMENDMENT IS APPROVED BY A MAJORITY OF THE VOTERS AT THE MARCH 14, 2000, ELECTION, THEN SUCH AMENDMENT SHALL BECOME A PART OF THE CITY CHARTER UPON CERTIFICATION AND ACCEPTANCE OF THE ELECTION RESULTS; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter Board has reviewed the revisions to Charter Section 4.08, has held a public hearing on the revisions, and recommends that Charter Section 4.08 is amended; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac that Article IV, Section 4.08 of the Tamarac Charter, entitled "Boards and advisory groups", be amended; and WHEREAS, pursuant to Chapter 166, Florida Statutes, a public hearing has been 1 Temp. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The following referendum question amending the City Charter shall be presented to the electorate of the City of Tamarac at the March 14, 2000, election and if the following referendum question is approved by a majority of the electorate at said election, the amendment proposed shall become a part of the City Charter upon Certification and acceptance of the election results: PROPOSED AMENDMENT CREATION OF CERTAIN BOARDS TO BE BY RESOLUTION SHOULD SECTION 4.08 OF THE TAMARAC CHARTER BE AMENDED TO ALLOW CERTAIN BOARDS, AUTHORITIES AND AGENCIES TO BE CREATED FOR A PERIOD OF UP TO ONE (1) YEAR BY RESOLUTION UNLESS PROHIBITED BY LAW? YES 7,1us If the proposed amendment is approved, Article IV, Section 4.08 entitled "Boards and advisory groups" will read as indicated below: Sec. 4.08. Boards and advisory groups. Temp. Ord. # 1854 6/17/99 Rev. #1 9/20/99 Rev. #2 10/25/99 Page 3 The commission may create by use resolution adjustment, regulatory and advisory boards, development authorities, redevelopment authorities and agencies, or by ordinance if required by statute or the board is intended to exist for a period exceeding one _(1)_year, specifying the duties and membership thereof. Members of these boards shall serve without compensation except for necessary expenses approved by the commission. All such boards shall be part of the city government and shall have utilize the services of the city manager, city clerk, and city attorney. When possible, each board and advisory group shall have at least one (1) member from each of the city's districts. SECTION 2: Codification: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 3: Conflicts: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: Severability: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not 1 1 1 P Temp. SECTION 5: Effective date: immediately upon its passage and adoption.
