Ord. #1856 4/6/99 Rev. #1 10/25/99 Page 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-99- AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING ARTICLE VI, QUALIFICATIONS AND ELECTIONS, SECTION 6.04, ENTITLED "ELECTIONS" OF THE CITY CHARTER, TO PROVIDE THAT CHARTER BOARD MEMBERS SHALL BE ELECTED BY DISTRICT, WITH THE AT -LARGE MEMBER ELECTED CITY WIDE; PROVIDING THAT IF THE AMENDMENT IS APPROVED BY A MAJORITY OF VOTERS AT THE MARCH 14, 2000, ELECTION, THEN SUCH AMENDMENT SHALL BECOME A PART OF THE CITY CHARTER UPON CERTIFICATION AND ACCEPTANCE OF THE ELECTION RESULTS; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter Board has reviewed the revisions to Charter Section 6.04, has held a public hearing on the revisions, and recommends that Charter Section 6.04 is amended; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac that the Tamarac Charter, Article VI, Section 6.04, entitled "Elections" be amended; and WHEREAS, pursuant to Chapter 166, Florida Statutes, a public hearing has been held on this matter. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE 1 Temp. Ord. #1856 4/6/99 Rev. #1 10/25/99 Page 2 CITY OF TAMARAC, FLORIDA: SECTION 1: The following referendum question amending the City Charter shall be presented to the electorate of the City of Tamarac at the March 14, 2000, election and if the following referendum question is approved by a majority of the electorate at said election, the amendment proposed shall become a part of the City Charter upon Certification and acceptance of the election results: PROPOSED AMENDMENT ELECTION OF CHARTER BOARD MEMBERS BY DISTRICT SHOULD SECTION 6.04 OF THE TAMARAC CHARTER BE AMENDED TO PROVIDE THAT CANDIDATES RUNNING FOR CHARTER BOARD SHALL RUN FOR ELECTION ONLY IN THE DISTRICT THE CANDIDATE PROPOSES TO REPRESENT, WITH THE EXCEPTION OF THE CANDIDATE FOR THE AT -LARGE SEAT, WHO SHALL RUN FOR ELECTION CITYWIDE? YES NO If the proposed amendment is approved, Article VI, Section 6.04 entitled "Elections" will read as indicated below: Sec. 6.04. Elections. There shall be no primary elections for municipal offices; the election for all municipal offices shall be held on the second Tuesday in March of the calendar year, unless changed by law. The candidate or candidates, depending upon the number to be elected, receiving the highest number of votes in the election shall be declared elected. In the event of a tie vote between two (2) or more candidates, the city shall arrange with the Broward County Supervisor of Elections for a special runoff election to be held within Temp. Ord. #1856 4/6/99 Rev. #1 10/25/99 Page 3 thirty (30) days after the special or general election. Duly elected municipal officers shall take office within ten (10) days after election with the specific day to be decided by ordinance. Each commissioner and charter board member shall be elected from one of the four (4) districts within the city and one member of the charter board shall be a member at -large. Qualified electors residing within the Gommis each district shall vote for not more than one (1) candidate for the ef#ise offices of city commissioner or charter board from that district and shall not be entitled to vote for candidates for city commission or charter board from any other oammi6sioR district. Candidates for al -ether the offices of mayor and the at -large member of the charter board shall run citywide. CODING: Words in struck through type are deletions from existing law; Words in underscored type are additions. SECTION 2: Codification: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 3: Conflicts: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: SeverabilitY- If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not 1 1 Temp. Ord. #1856 4/6/99 Rev. #1 10/25/99 Page 4 affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. SECTION 5: Effective date: immediately upon its passage and adoption.
