Ord. #1861 5/11 /99 Rev. #1 10/25/99 Page 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-99- c� g AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING ARTICLE VIII, CHARTER BOARD, SECTION 8.01, ENTITLED "TERMS AND QUALIFICATIONS" OF THE CITY CHARTER, TO PROVIDE THAT CHARTER BOARD TERMS OF OFFICE SHALL BE CHANGED FROM TWO YEARS TO THREE YEARS, AND THAT ELECTION OF CHARTER BOARD MEMBERS SHALL COINCIDE WITH ELECTION OF COMMISSIONERS FROM SAME DISTRICTS, WITH ELECTION OF AT LARGE MEMBER TO COINCIDE WITH DISTRICTS 2 AND 4; PROVIDING THAT IF THE AMENDMENT IS APPROVED BY A MAJORITY OF THE VOTERS AT THE MARCH 14, 2000, ELECTION, THEN SUCH AMENDMENT SHALL BECOME A PART OF THE CITY CHARTER UPON CERTIFICATION AND ACCEPTANCE OF THE ELECTION RESULTS; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter Board has reviewed the revisions to Charter Section 8.01, has held a public hearing on the revisions, and recommends that Charter Section 8.01 is amended; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac that Article VIII, Section 8.01, entitled "Terms and qualifications", be amended; and WHEREAS, pursuant to Chapter 166, Florida Statutes, a public hearing has been held on this matter. Ord. #1861 5/11 /99 Rev. #1 10/25/99 Page 2 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The following referendum question amending the City Charter shall be presented to the electorate of the City of Tamarac at the March 14, 2000, election and if the following referendum question is approved by a majority of the electorate at said election, the amendment proposed shall become a part of the City Charter upon Certification and acceptance of the election results: PROPOSED AMENDMENT LENGTH OF TERM AND ELECTION OF CHARTER BOARD MEMBERS SHOULD SECTION 8.01 OF THE TAMARAC CHARTER BE AMENDED SO THAT TERMS OF OFFICE FOR CHARTER BOARD MEMBERS SHALL BE INCREASED FROM TWO TO THREE YEAR TERMS, AND ELECTION OF CHARTER BOARD MEMBERS FROM EACH DISTRICT ARE IN THE SAME YEAR AS COMMISSIONERS FROM THE SAME DISTRICTS, WITH THE AT LARGE MEMBER ELECTED WITH MEMBERS FROM DISTRICT 2 AND 4? YES NO If the proposed amendment is approved, Article VIII, Charter Board, Section 8.01, entitled "Terms and qualifications" will read as indicated below: Sec. 8.01. Terms and qualifications. (a) Membership. The charter board shall consist of five (5) members. Four (4) members shall reside in different districts, and one (1) member shall run at large. Charter board members from odd numbered districts and the 'mot_ large ^mom-hnr Districts 1 and 3 shall be elected in each odd numbered „oor the vear Commission representatives of Districts 1 and 3 are elected, beginning with the municipal election of March 2002 and charter board members from even numbered diStFiGts Districts 2 and 4 shall be elected in Temp. The at large member shall be elected with the members from Districts 2 and 4. Char ter Board members serving as of March 1.999,from_Districts 1 and 3 shall serve until the election is held in March,- 2002. Charter Board members servinq as of March, 2000, from Districts 2 and 4, and the at large member, shall serve until the election is held in March 2003. Beginning with the 1985 municipal election and effective for all elections thereafter, charter board members who are elected to office shall not succeed themselves for more than one (1) term, without an intervening term, regardless of the district or seat they might hold. .. .• .•. _ .• CODING: Words in struck thFough type are deletions from existing law; Words in underscored type are additions. SECTION 2: Codification: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 3: Conflicts: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. 1 1 Temp. Ord. #1861 5/11 /99 Rev. #1 10/25/99 Page 4 SECTION 4: Severability: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. SECTION 5: Effective date: immediately upon its passage and adoption.
