Ord.#1870 Page 1 November 1, 1999 Revision #1 November 9, 1999 Revision #2 November 10, 1999 ORDINANCE NO. 0-99- a4 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING TAMARAC CODE, CHAPTER 6 "FINANCE AND TAXATION," ARTICLE V "PURCHASING PROCEDURES," SECTION 6- 149(a), "PURCHASING PROCEDURES," PROVIDING THAT ALL CONTRACTUAL SERVICES AS DEFINED IN SECTION 6-141, "DEFINITIONS" IN EXCESS OF THIRTY THOUSAND DOLLARS BE AWARDED THROUGH THE USE OF COMPETITIVE SEALED BIDS AND PROPOSALS; PROVIDING FOR CODIFICATION, PROVIDING FOR REPEALER, PROVIDING FOR SEVERABILITY, AND PROVIDING FOR AN EFFECTIVE DATE, WHEREAS, Charter Section 7.11 requires all contracts for the purchase of capital equipment, and for improvement and construction contracts of any type, available from more than one (1) source, or which cannot be performed with city personnel which shall exceed the sum of ten thousand dollars ($10,000) shall be competitively bid: and WHEREAS, Charter Section 7.11 is the only Charter Section which addresses the $10,000 bid limit and the language is limited to capital equipment and construction type contracts; and WHEREAS, City Code Section 6-141 entitled "Definitions" describes contractual services as the purchase of insurance, printing, gas, electricity, fuel, towel and cleaning services; the purchase, installation, rental, repair and maintenance of equipment and machinery, and other personal property; lease of real property and office space, and all other contractual supplies, materials, equipment and services; and CODING: Words in struck thFa gh type are deletions from existing law; Words in underscored type are additions. Temp. Ord.#1870 Page 2 November 1, 1999 Revision #1 November 9, 1999 Revision #2 November 10, 1999 WHEREAS, Section 6-149 entitled "Purchasing Procedures" (a) states "Generally. Except as otherwise provided in this article, all contracts of the city involving dollar amounts in excess of ten thousand dollars ($10,000) shall be awarded through the use of competitive sealed bids and competitive sealed proposals; and WHEREAS, it is necessary for the City of Tamarac to purchase a wide variety of materials and supplies on a day-to-day basis in order to maintain service to its citizens; and WHEREAS, in order to enhance departmental productivity, efficiency and expediency, it is necessary for the formal bid limit for all contractual supplies as defined in said Section 6-141 be increased to a minimum of $30,000; and WHEREAS, guidelines for obtaining informal quotations for the purchase of materials, supplies and other contractual services below the $30,000 threshold will be established and defined in the City's Purchasing Administrative Policy #96-06; and WHEREAS, the Assistant City Manager/Interim Director of Finance and Purchasing/Contracts Manager recommend approval; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to amend Chapter 6, Article V, Sections 6-149 (a) by increasing the competitive sealed bid and proposal limit to $30,000. That the foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. Section 2. That Article V, Section 6-149 is hereby amended as follows: Section 6-149. Purchasing Procedures. a) Generally. Except as otherwise provided in this article or by Charter, all contracts of the city involving dollar amounts in excess of teR thebisand dellaFS, ($10 000) thirty thousand dollars 30 OQO shall be awarded through the use of competitive sealed bids and competitive sealed proposals. Section 3. Codification: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered, relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. Section 4. That all Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. That if any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. Section 6. That the provisions of this Ordinance shall become effective immediately upon its passage and adoption.
