Ordinance #1877- November 30,1999 Revision #1 -- December 6, 1999 Page 1 CITY OF TAMARAC, FLORIDA Ordinance NO. 0 -' "0.0 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA AMENDING CHAPTER 19 OF THE TAMARAC CODE, ENTITLED "SOLID WASTE", SECTION 19-54 "BILLING", ALLOWING FOR THE INCLUSION OF SOLID WASTE COLLECTION AND DISPOSAL FEES ON THE UTILITY BILL AND ESTABLISHING A PROCESS FOR THE APPLICATION OF PARTIAL PAYMENTS TO THE UTILITY BILL; AMENDING CHAPTER 22 ENTITLED "UTILITIES" SECTION 22-130 "CHANGE OF OCCUPANCY", PROVIDING FOR TELEPHONE ORDERS FOR THE DISCONTINUANCE OR TRANSFER OF SOLID WASTE COLLECTION SERVICE; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, City has determined that it is in the best interest of the City of Tamarac to bill and collect the fee for single family residential solid waste collection and disposal services as part of the utility bill; and WHEREAS, the City wishes to establish a process for the application of partial payments to the utility bill; and WHEREAS, the City Commission of the City of Tamarac wishes to provide for the acceptance of telephone orders for the transfer or discontinuation of solid waste collection service as a convenience to the residents; and WHEREAS, the City Manager and the Assistant City Manager recommend approval of the changes to Chapters 19 of the Tamarac Code entitled "Solid Waste" and Chapter 22 of the Tamarac Code entitled "Utilities"; and Temp. Ordinance #1877 —November 30, 1999 Revision #1 — December 6, 1999 Page 2 WHEREAS the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the Citizens and residents of the City of Tamarac to amend Chapter 19 of the Tamarac Code entitled "Solid Waste" and Chapter 22 of the Tamarac Code entitled "Utilities" by adopting the amendments. NOW THEREFORE BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. Section 2: Chapter 19 of the Tamarac Code, entitled "Solid Waste" is amended as follows: See.19-54. Billing (b) Payment of the gaFbage solid waste collection and disposal fee fees shall be due and payable simultaneously with all other charges itemized on the utility bill. If a customer shall Pay less that the entire utility bill the paVment shall be proportionately applied to all charges itemized on the utility bill. Nonpayment of s rhfee the utility bill_ in its entirety shall be grounds for discontinuance of utility service in accordance with the procedures established in Chapter 22 of this Code. The garbage solid waste collection and disposal fee fees shall continue to be assessed regardless of any temporary discontinuation of utility service pursuant to Chapter 22 of this Code. Section 3: Chapter 22 of the Tamarac Code, entitled "Utilities" is amended as follows: E Temp. Ordinance #1877 —November 30, 1999 Revision #1 — December 6, 1999 Page 3 Section 22-130. Change of Occupancy (b) For the convenience of its consumers, the city will accept telephone orders to discontinue or transfer water service and solid waste collection service and will use all reasonable diligence in the execution thereof. However, oral orders or advice cannot be deemed binding or be considered formal notification to the city. Section 4: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida and that the Sections of this Ordinance may be renumbered or relettered and the word "Ordinance may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. Section 5: All Ordinances or parts of Ordinances, and Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. Section 6: If any clause, section, other part or application of this Ordinance is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or in application, it shall not affect the validity of the remaining portion or applications of this Ordinance. 1 CJ C 1 Temp.
