Ord. #1897 May 10, 2000 Page 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2000 — AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING THE EXECUTION AND DELIVERY OF CERTAIN LEASE DOCUMENTS IN CONNECTION WITH THE PROPOSED FINANCING OF A FIRE RESCUE VEHICLE UNDER THE EXISTING AND APPROVED MASTER LEASE -PURCHASE AGREEMENT BETWEEN THE CITY AND KISLAK NATIONAL BANK; AMENDING THE ANNUAL BUDGET OF ESTIMATED REVENUES AND EXPENDITURES FOR THE PURCHASE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, by Resolution R-99-331 adopted by the City Commission November 18, 1999, the City has approved the acquisition of one Rescue Vehicle (the "Vehicle") at a cost of $140,000; and WHEREAS; the City has determined that it is in the best interests of the City and its citizenry to acquire the Vehicle pursuant to a lease -purchase financing arrangement with Kislak National Bank (the "Lessor"); and WHEREAS; the City wishes to utilize the existing approved Master Lease with Kislak National Bank as approved by City of Tamarac Resolution 2000-95, March 16, 2000; and WHEREAS; the lease documents and various closing documents related to the lease -purchase financing of the Equipment will be finalized and Temp. Ord. #1897 May 10, 2000 Page 2 substantially final forms of such documents shall be on file with the City Clerk; and WHEREAS, the acceptance of these funds requires the amending of budgeted revenues and expenditures of appropriate City Funds; and WHEREAS, the City Manager has recommended these amendments to the Fiscal Year 2000 budget to properly account for all budgetary actions related to the lease -purchase of the Vehicle; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interest of the citizens and residents of the City of Tamarac to amend the FY 00 Budget to address the actions needed to implement the lease - purchase of the Vehicle. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance upon adoption hereof. SECTION 2: The appropriate City Officials are hereby authorized and directed to execute the lease -purchase financing agreement with Kislak National Bank, attached hereto as Exhibit "A" and made part hereof, which agreement provides for the financing's principal amount, interest rate and repayment terms. 1 Temp. Ord. #1897 May 10, 2000 Page 3 SECTION 3: The budget of the City of Tamarac is hereby amended, in accordance with the Vehicle Lease -Purchase Document and all necessary budgetary transfers of funds are hereby approved. SECTION 4: Conflicts: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: Severability: If any provision of this Ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance than can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. 1 Temp.
