Ord. #1907 1 Revision No. 1 - August 16, 2000 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2000- a AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ADOPTING AMENDMENTS TO THE RECREATION AND OPEN SPACE AND CONSERVATION ELEMENTS OF THE CITY OF TAMARAC COMPREHENSIVE PLAN IN ACCORDANCE WITH CHAPTER 163, SUBSECTION 163.3177(6)(a) OF THE FLORIDA STATUTES CONCERNING TEXT AMENDMENTS RELATING TO ADDITIONAL PROTECTION AND RESTORATION OF WETLAND AND NATURAL RESOURCE AREAS AND COORDINATED EFFORTS TO PROVIDE ADDITIONAL OUTDOOR RECREATION AREAS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, provisions of the Local Government Comprehensive Planning and Land Development Regulation Act of 1985 require adoption of a comprehensive plan; and WHEREAS, the City of Tamarac, Florida, pursuant to said Local Government Comprehensive Planning Act, and in accordance with all its terms and provisions, has prepared and adopted a comprehensive plan which has been submitted to and reviewed by the South Florida Regional Planning Council (SFRPC) and the State Department of Community Affairs (DCA); and WHEREAS, the City of Tamarac Planning Board, as the Local Planning Agency, has 11 August 9, 2000 - Temp. Ord. #1907 2 Revision No. 1 - August 16, 2000 reviewed this Text Amendment to the Recreation and Open Space and Conservation Elements of the Comprehensive Plan (attached hereto as Exhibit "A"), held a public hearing on August 16, 2000 and recommends approval; and WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the City Commission of the City of Tamarac held the first public hearing on August 23, 2000 pursuant to Chapter 163 of the Florida Statutes to consider transmittal of the proposed amendment to the Comprehensive Plan; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to adopt amendments to the Recreation and Open Space and Conservation Elements of the City of Tamarac Comprehensive Plan in accordance with Chapter 163, Subsection 163.3177(6)(a) of the Florida Statutes concerning text amendments relating to additional protection and restoration of wetland and natural resource areas and coordinated efforts to provide additional outdoor recreation areas. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance L� 1 1 August 9, 2000 - Temp. Ord. #1907 3 Revision No. 1 - August 16, 2000 upon adoption hereof. SECTION 2: That amendments to the Recreation and Open Space and Conservation Elements of the City of Tamarac Comprehensive Plan (Case No. 2-LUA-00) reviewed by the Planning Board and approved by the City Commission, attached hereto and made a part of this Ordinance as shown on Exhibit A, concerning text amendments relating to additional protection and restoration of wetland and natural resource areas and coordinated efforts to provide additional outdoor recreation areas, are HEREBY SECTION 3: All Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. SULTAiNO, DIST 4: VIM ROBERTS LY91iA EXHIBIT A CITY OF TAMARAC PROPOSED COMPREHENSIVE PLAN AMENDMENTS (Underlined sections represent changes/additions to the Comprehensive Plan) The following amendment to Objective 2 and new policies will be incorporated into the Recreation and Open Space Element of the City's adopted Comprehensive Plan: Objective 2 The City will meet the open space needs of the citizens by providing for passive recreation. These may consist of natural areas, open space, road right-of-ways, power line right-of-ways, and canal maintenance easements. The provision, and protection of resources and acquisition of open sace shall be coordinated between the public and private sectors. Policy 2.5 The City will endeavor to emplov a variety of methods to ensure the protection and/or restoration of natural areas reenwa s and open s ace through public ac uisition including; rant funds impact fees capital 'improvement funds land dedications and joint City/County/State projects and partnerships, Policy 2.6 The City will work with Broward County and neighborin municipalities to create a Countywide greenways and trails network designed to link environmentalIV sensitive lands open s ace arks waterways, other outdoor recreation opportunities and facilities cultural and historic sites. The following amendment to Policy 6.4 and new Policy 6.6 will be incorporated into the Conservation Element of the City's adopted Comprehensive Plan: Policy 6.4 The City will protect native vegetative communities from destruction by development activities by implementing the requirements of the County's Local Areas of Particular Concern environmental legislation. The Community Development Department will during the planning period review its site plan and landscape plan requirements to identify additional means of protecting native vegetative communities such as; removal of non-native vegetation and exotics lantin of new native species, no more than 30% of the native vegetation on site may be destroyed during the development process, applicant shall relocate native vegetation to other locations on the site plan during the development process and will ensure that it is protected and maintained. Policy 6.6 In an effort to further protect wetland resources the City will endeavor to protect, restore and enhance aquatic vegetation and/or identifv natural resource areas.
