Ord. #1912 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2000-31 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO AMEND THE SHIP FUND BUDGET OF ESTIMATED REVENUES AND EXPENDITURES BY ACCEPTING AN ADDITIONAL ALLOCATION OF $146,967.00 OF THE STATE OF FLORIDA'S STATE HOUSING INITIATIVES PARTNERSHIP (SHIP) PROGRAM FUNDS FOR FISCAL YEAR 2000-2001 THEREBY INCREASING THE FUNDING FOR FISCAL YEAR 2000-2001 TO $572,579.00 TO BE UTILIZED ACCORDING TO THE CITY'S LOCAL HOUSING ASSISTANCE PLAN AND HOUSING DELIVERY GOALS CHART; AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO APPROPRIATE SAID FUNDS INCLUDING ANY AND ALL SUBSEQUENT BUDGETARY TRANSFERS; CASE NO. 12-MI- 00; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on January 31, 2000 the City of Tamarac was informed that the City of Tamarac's anticipated State Housing Initiatives Partnership (SHIP) allocation for Fiscal Year 2000-2001 would be approximately $426,431.00 (see Exhibit 1" attached hereto), and WHEREAS, on May 10, 2000 the City Commission of the City of Tamarac adopted Resolution No. R-2000-116 accepting the original anticipated SHIP allocation of September 7, 2000 - Temp. Ord. #1912 2 $426,431.00 for Fiscal Year 2000-2001 and amended the SHIP Fund Budget of Estimated Revenues for Fiscal Year 2000-2001 to reflect said acceptance; and WHEREAS, on July 10, 2000 the State of Florida notified the City of Tamarac of an excess collection of documentary stamps revenue which provides funding for the City's State Housing Initiatives Partnership (SHIP) Program to be shared with all SHIP Program participants (see Exhibit "2" attached hereto); and WHEREAS, on July 10, 2000 the State's SHIP Program effectively reduced the original allocation from $426,431.00 to $425,612.00 and allocated an additional $146,967.00 thereby increasing the City of Tamarac's SHIP FY 2000-2001 allocation to $572,579.00; and WHEREAS, the City will utilize the additional funds according to its Local Housing Assistance Plan and Housing Delivery Goals Chart (see Exhibit "3" attached hereto) and WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to authorize the appropriate City Officials to amend the SHIP Fund Budget of estimated revenues and expenditures by accepting an additional allocation of $146,967.00 of the State of Florida's State Housing Initiatives Partnership (SHIP) Program funds for Fiscal Year 2000-2001 thereby increasing the funding for Fiscal Year 2000-2001 to $572,579.00 to be utilized according to the City's Local Housing Assistance Plan and Housing Delivery Goals Chart. 1 September 7, 2000 - Temp. Ord. #1912 3 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance upon adoption hereof. SECTION 2: That the appropriate City Officials are hereby authorized to amend the SHIP Fund Budget of estimated revenues and expenditures by accepting an additional allocation of $146,967.00 of the State of Florida's State Housing Initiatives Partnership (SHIP) Program funds for Fiscal Year 2000-2001 thereby increasing the funding for Fiscal Year 2000-2001 to $572,579.00 to be utilized according to the City's Local Housing Assistance Plan and Housing Delivery Goals Chart. SECTION 3: That the Mayor and City Commission authorizes the appropriate City Officials to amend the SHIP Fund Budget in the amount of $146,967.00 and appropriate said funds, including any and all subsequent budgetary transfer, to be in accordance with proper accounting standards. SECTION 4: All Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or 1 r— September 7, 2000 - Temp. Ord. #1912 4 application, and to this end the provisions of this Ordinance are declared to be severable. SECTION 6: This Ordinance shall become effective immediately upon its passage and adoption. The total allocation for this year has been increased to $123,100,000. Please forward a copy to your finance department. This chart reflects the most recent calculation of the local housing distribution for the State Housing Initiatives Partnership Program. This breakdown is an estimate due to the fact that we do not have the most current population data. We will update these allocation tables as changes are made to the table. Also enclosed for the Local Governments renewing their Local Housing Assistance Plan (LHAP) this year is an outline and checklist of items the SHIP Review Committee will be looking for in each plan. Please remember to use these new financial allocations in your LHAP housing delivery goals charts. The January 2000 allocation collections should be distributed by the middle of next week. With this distribution, the total SHIP allocation for FYI 999-2000 will be nearly eighty five percent (85%) funded. We expect to have excess collections for this fiscal year. Please plan accordingly. Finally, enclosed are copies of the Florida Statutes and the Administrative Rule governing the State Housing Initiatives Partnership (SHIP) Program. The Rule was amended to reflect the required changes by the Joint Administrative Procedures Committee (JAPC). This sheet may look a little different to you because it has incorporated into it the April, May, and June 2000 Collections. Column One identifies each Local Government by County and City. Column Two identifies the projected FY 2000-01 Allocation of $123,100,000 by participating County. Colutnn Three identifies the original FY 2000-01 Allocation of $123,100,000 by participating Crounty and City. Column Four identifies the April, May, and June Collections of$36,488,616.83 by participating County and City, Column Five identifies the Total Allocation of S 159,588,616.83 by participating County and City. The April, May, and June Collections are the first payment of this fiscal year. April, May, and June Disbursement (column four) plus the Projected Allocation (column three) equals the Total Projected Allocation (column five) for FY2000-2001. The Total Allocation Amount (column five) is what you should budget for this fiscal year. Please notify your Finance Department of this new FY 2000-2001 Total Allocation, Please submit a new 2000-2001 Housing Delivery Goals Chart to reflect the Total Allocation (column five). Please remember to allocate this new distribution into your Homeownership and Rental Strategies as well as the Administrative Line Item.
