HomeMy WebLinkAboutCity of Tamarac Ordinance O-2001-003December 27, 2000 -- Temp Ord #1918 1 Revision #1 December 27, 2000 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2001- 0.3 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING PRIOR ZONING OF CERTAIN REAL ESTATE PROPERTY FROM A-1 (LIMITED AGRICULTURAL DISTRICT) TO LI-1 (LIGHT INDUSTRIAL DISTRICT); LANDS COMMONLY KNOWN AS A REPLAT OF PORTIONS OF TRACTS 3, 4 AND 5, ALL IN SECTION 7, TOWNSHIP 49 SOUTH, RANGE 41 EAST OF THE "FLORIDA FRUIT LANDS COMPANY SUBDIVISION NO. 2" PLAT, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 1, PAGE 102 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA, LOCATED NORTH OF COMMERCIAL BOULEVARD BETWEEN HIATUS ROAD AND NOB HILL ROAD; CASE NO. 16-Z-00; PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING MAP TO REFLECT SUCH CHANGE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, petitioner has requested that certain real estate property located north of Commercial Boulevard between Hiatus Road and Nob Hill be rezoned from A-1 (Limited Agricultural District) to LI-1 (Light Industrial District) to be consistent with the City's adopted Comprehensive Plan, adjoining properties, and to accommodate future development; and WHEREAS, pursuant to the provisions of the Code of Ordinances of the City of Tamarac, Florida, public notice has been given of the time and place of the public hearing C, December 27, 2000 - Temp Ord #1918 2 Revision #1 December 27, 2000 0 regarding the rezoning of the property described herein and said public hearing will be held in accordance with the notice and the public will be given an opportunity to be, and will be heard; and WHEREAS, the public hearing will be held on Case No. 16-Z-00 by the City Commission pursuant to the Charter and Florida State Statutes; and WHEREAS, on December 6, 2000, the Planning Board held a duly advertised Public Hearing and recommended approval of the rezoning; and WHEREAS, the Director of Community Development recommends approval of this rezoning; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems the rezoning to be consistent with the City of Tamarac Comprehensive Plan; and 0 WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to rezone the property from A-1 (Limited Agricultural District) to LI-1 (Light Industrial District); lands commonly known as a Replat of portions of Tracts 3, 4 and 5, all in Section 7, Township 49 South, Range 41 East of the "Florida Fruit Lands Company Subdivision No. 2" Plat, according to the Plat thereof as recorded in Plat Book 1, Page 102 of the Public Records of Palm Beach County, Florida, located north of Commercial Boulevard between Hiatus Road and Nob Hill Road; Case No. 16-Z-00. 0 December 27, 2000 - Temp Ord #1918 3 Revision #1 December 27, 2000 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance upon adoption hereof. SECTION 2: That the lands commonly known as a Replat of portions of Tracts 3, 4 and 5, all in Section 7, Township 49 South, Range 41 East of the "Florida Fruit Lands Company Subdivision No. 2" Plat, according to the Plat thereof as recorded in Plat Book 1, Page 102 of the Public Records of Palm Beach County, Florida, located north of is Commercial Boulevard between Hiatus Road and Nob Hill Road (attached hereto as Exhibit "A") are hereby rezoned from A-1 (Limited Agricultural District) to LI-1 (Light Industrial District). SECTION 3: That the official zoning map of the City of Tamarac shall be changed to reflect such zoning, said changes to be made by the Director of Community Development,., together with the effective date of this Ordinance. 'SECTION 4: All Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions, in,conflict herewith are hereby repealed to the extent of such conflict. r- -1 1.__J December 27, 2000 - Temp Ord #1918 4 Revision #1 December 27, 2000 SECTION 5_ If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
