HomeMy WebLinkAboutCity of Tamarac Ordinance O-2001-0051 February 23, 2001 - Temp Ord #1923 1 Revision No. 1 - March 6, 2001 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2001- 05' AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 9 ENTITLED, "HEALTH, SANITATION AND NUISANCES", BY AMENDING ARTICLE IV ENTITLED, "THE LOCAL HOUSING ASSISTANCE PROGRAM", BY AMENDING SECTION 9-130 "DEFINITIONS", CORRECTING THE STATE RENUMBERED CHAPTER REFERENCE FROM "91-37" TO "67-37"; BY DELETING SECTION 9-134 ENTITLED, "ESTABLISHMENT OF AFFORDABLE HOUSING ADVISORY COMMITTEE", (AS A COMPLETED TASK); BY DELETING SECTION 9-135 ENTITLED, "REVIEW AND APPROVAL OF THE AFFORDABLE HOUSING INCENTIVE PLAN", (AS A COMPLETED TASK); CASE NO. 9-MI-01; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE nATF WHEREAS, the City Commission of the City of Tamarac wishes to provide for the housing needs of its citizens and to promote efficient location, design and provision of affordable housing; and WHEREAS, the State Housing Initiatives Partnership Act ("Act") provides for the establishment of subsequent modifications to the Local Housing Assistance programs; and WHEREAS, the City of Tamarac's existing Code of Ordinances requires that minor amendments be made to its Local Housing Assistance Program; and CODING: Words in struck through type are deletions from existing law; Words in underscored type are additions. February 23, 2001 — Temp Ord #1923 2 Revision No. 1 — March 6, 2001 WHEREAS, Section 9-130 of the City's Code of Ordinances references the adoption of the definitions contained in the State Housing Partnership Act (the "Act") and Chapter 91-37 of the State of Florida Administrative Code as they may be amended from time to time; and WHEREAS, Chapter 91-37 of the State of Florida Administrative Code has been renumbered to Chapter 67-37, thereby creating the need for an amendment to Section 9- 130 of the City of Tamarac Code of Ordinances to ensure consistency with the State of Florida Administrative Code; and WHEREAS, the City had established an Affordable Housing Advisory Committee pursuant to State Housing Initiatives Program requirements codified in the City of Tamarac's Code of Ordinance as Section 9-134, which established the composition of the committee to perform the task of reviewing and approving an affordable housing incentive plan as defined in the City's Code of Ordinance 9-135; and WHEREAS, the appointed Affordable Housing Advisory Committee has successfully completed its task and as the State has repealed Florida Administrative Code 67-37.009, which established the committee, the City's Code of Ordinance 9-134 is being deleted to maintain consistency with the Florida Administrative Code; and CODING: Words in StFUGk thFOUgti type are deletions from existing law; Words in underscored type are additions. J 11 February 23, 2001 - Temp Ord #1923 3 Revision No. 1 - March 6, 2001 WHEREAS, the task of reviewing and approving the affordable housing incentives contained in the City's Code of Ordinance 9-135 pursuant to Florida Administrative Code 67-37.010 has been completed by the Affordable Housing Advisory Committee, and it is recommended that the Code section be deleted; and WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to amend Chapter 9 entitled, "Health, Sanitation and Nuisances", by amending Article IV entitled, "The Local Housing Assistance Program", by amending Section 9-130 "Definitions", correcting the State Renumbered Chapter Reference from "91-37" to "67-37"; by deleting Section 9-134 entitled, "Establishment of Affordable Housing Advisory Committee", (as a completed task); by deleting Section 9-135 entitled, "Review and Approval of the Affordable Housing Incentive Plan", (as a completed task). NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: CODING: Words in StF GI( through- type are deletions from existing law; Words in underscored type are additions. February 23, 2001 -- Temp Ord #1923 4 Revision No. 1 - March 6, 2001 SECTION 1: That the foregoing "WHEREAS"clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance upon adoption hereof. SECTION 2: Chapter 9 entitled, "Health, Sanitation and Nuisances", Article IV entitled, "The Local Housing Assistance Program", is hereby amended: Sec. 9-130. Definitions. For the purposes of this Article, the definitions contained in the State Housing Partnership Act (the "Act") and Chapter 94-27 67-37 of the Florida Administrative Code, as they may be amended from time to time, are adopted herein by reference. February 23, 2001 - Temp Ord #1923 6 Revision No. 1 - March 6, 2001 SECTION 3: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: All Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. 1 SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
