WHEREAS, the City Commission of the City of Tamarac wishes to remove any duplication of certain State Statute misdemeanor offenses contained in the City of Tamarac's Code of Ordinances; and WHEREAS, the City of Tamarac has been advised of desirable changes to be made to Chapter 13 entitled, "Miscellaneous Offenses", Section 13-2, "Public property— Injuring, destroying, etc.", Section 13-3, "Same —Tampering with, breaking into, etc.; exceptions for authorized personnel", and Section 13-6, "Trespassing"; and CODING: Words in StFUGk thFough type are deletions from existing law; Words in underscored type are additions. August 20, 2001 — Temp Ord #1940 Revision No. 1 — September 12, 2001 Revision No. 2 — September 17, 2001 Revision No. 3 — September 19, 2001 2 *1 WHEREAS, the above -identified sections relate to crimes that are classified as misdemeanor offenses of state law which are adopted by Section 13-1 of the City's Code of Ordinances as a municipal code violation but are more effectively prosecuted by using the pertinent State Statute offense; and WHEREAS, the City Commission of the City of Tamarac desires to utilize the most effective prosecution for violations of state laws by amending affected codes in the City's Code of Ordinances; and WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to amend Chapter 13 entitled, "Miscellaneous Offenses", deleting Section 13-2 entitled, "Public property — Injuring, destroying, etc"; deleting Section 13-3 entitled, "Same —tampering with, breaking into, etc.; exceptions for authorized personnel"; and deleting Section 13-6 entitled, "Trespassing", in order to provide for prosecution of violations at State level as statutory violations. SECTION 4: All Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
