HomeMy WebLinkAboutCity of Tamarac Ordinance O-2001-021September 7, 2001 - Temp Ord #1941 1 Revision No. 1 - September 12, 2001 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2001-21 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING PRIOR ZONING OF CERTAIN REAL ESTATE PROPERTY FROM A-1 (LIMITED AGRICULTURAL DISTRICT) TO S-1 (OPEN SPACE/RECREATIONAL DISTRICT); LANDS COMMONLY KNOWN AS A PORTION OF TRACT 16, SECTION 7, TOWNSHIP 49 SOUTH, RANGE 41 EAST OF THE "FLORIDA FRUIT LANDS COMPANY'S SUBDIVISION NO. 2" PLAT, ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 1, PAGE 102 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY, FLORIDA, LYING IN THE CITY OF TAMARAC, BROWARD COUNTY, FLORIDA, LOCATED ON THE SOUTH SIDE OF WEST MCNAB ROAD, WEST OF NW 108 TERRACE; CASE NO. 17-Z-01; PROVIDING FOR AMENDMENT OF THE OFFICIAL ZONING MAP TO REFLECT SUCH CHANGE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in FY 2000 the City of Tamarac purchased a parcel of land (described in Exhibit "A" attached hereto) for the purpose of developing a park; and WHEREAS, the subject property as described in Exhibit "A" is currently zoned A-1 (Limited Agricultural District); and WHEREAS, the City of Tamarac has proposed that the subject property located on the south side of West McNab Road , west of NW 108 Terrace be rezoned from A-1 (Limited Agricultural District) to S-1 (Open Space/Recreational District) in order to facilitate development of a park; and September 7, 2001 -- Temp Ord #1941 2 Revision No. 1 - September 12, 2001 WHEREAS, pursuant to the provisions of the Code of Ordinances of the City of Tamarac, Florida, public notice has been given of the time and place of the public hearing regarding the rezoning of the property described herein and said public hearing will be held in accordance with the notice and the public will be given an opportunity to be, and will be heard; and WHEREAS, the public hearing will be held on Case No. 17-Z-01 by the City Commission pursuant to the Charter and Florida State Statutes; and WHEREAS, on September 5, 2001, the Planning Board held a duly advertised Public Hearing and recommended approval of the rezoning; and WHEREAS, the Director of Community Development recommends approval of this rezoning; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems the rezoning to be consistent with the City of Tamarac Comprehensive Plan; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to rezone the property from A-1 (Limited Agricultural District) to S-1 (Open Space/Recreational District); lands commonly known as a portion of Tract 16, Section 7, Township 49 South, Range 41 East of the "Florida Fruit Lands Company's Subdivision No. 2" Plat, according to the Plat thereof as recorded in Plat Book 1, Page 102 of the Public Records of Palm Beach County, Florida, lying in the City of Tamarac, Broward County, Florida, located on the south side of September 7, 2001 -- Temp Ord #1941 3 Revision No. 1 - September 12, 2001 West McNab Road, west of NW 108 Terrace. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance upon adoption hereof. SECTION 2: That the lands commonly known as a portion of Tract 16, Section 7, Township 49 South, Range 41 East of the "Florida Fruit Lands Company's Subdivision No. 2" Plat, according to the Plat thereof as recorded in Plat Book 1, Page 102 of the Public Records of Palm Beach County, Florida, lying in the City of Tamarac, Broward County, Florida (attached hereto as Exhibit "A"), located on the south side of West McNab Road, west of NW 108 Terrace are hereby rezoned from A-1 (Limited Agricultural District) to S-1 (Open Space/Recreational District). SECTION 3: That the official zoning map of the City of Tamarac shall be changed to reflect such zoning, said changes to be made by the Director of Community Development, together with the effective date of this Ordinance. SECTION 4: All Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions, in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions September 7, 2001 -- Temp Ord #1941 4 Revision No. 1 - September 12, 2001 or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. SECTION 6: This Ordinance shall become effective immediately upon its passage and adoption. PASSED, FIRST READING this 26' day of September, 2001.
