Ord. 2006 Revision No. 1 — May 1, 2003 Revision No. 2 — May 7, 2003 Revision No. 3 — May 8, 2003 Page 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2003- Oyu AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 24 OF THE CODE OF ORDINANCES ENTITLED, "ZONING", ARTICLE VI, "ACCESSORY USES`, CREATING SECTION 24-614 ENTITLED, "PLACEMENT OF BASKETBALL HOOPS AND POLES" ESTABLISHING REQUIREMENTS FOR THE PLACEMENT OF BASKETBALL HOOPS AND POLES (CASE NO. 15-Z-03); PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Tamarac has determined that placement of basketball hoops and poles near and in roadways constitutes a public safety concern; and WHEREAS, per the request of the City Commission of the City of Tamarac, Community Development staff has researched this issue and has created standards to regulate the placement of such structures, thereby enhancing the safety of citizens and residents; and WHEREAS, the Director of Community Development recommends approval of this code amendment; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to amend Chapter 24 entitled, "Zoning", Article VI, "Accessory Uses`, by creating April 4, 2003 --- Temp. Ord. 2006 Revision No. 1 — May 1, 2003 Revision No. 2 — May 7, 2003 Revision No. 3 — May 8, 2003 Page 2 Section 24-614 establishing requirements for the placement of basketball hoops and poles. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance upon adoption hereof. SECTION 2: Chapter 24 entitled, "Zoning", Article VI, "Accessory Uses*", is hereby amended by creating Section 24-614 entitled, "Placement of Basketball Hoops and Poles" as follows: Sec. 24-614. Placement of basketball hoops and poles. a All basketball hoops and backboards in street yard areas shall be permitted on the front of the building or on a ole on or adiacent to the driveway only. b Fixed basketball poles shall be located no closer than five 5 feet to an property line or edge of pavement. c Portable basketball poles shall not be placed in a right-of-way or outside a property line. When not in use, any portable basketball pole shall be stored at least five (5) feet from the property line, 1 L_J 1 1 1 April 4, 2003 — Temp. Ord. 2006 Revision No. 1 — May 1, 2003 Revision No. 2 — May 7, 2003 Revision No. 3 — May 8, 2003 Page 3 SECTION 3: It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 4: All Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. gFC'.TI0K1 F upon adoption.
