Ord. #1976 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2003- /S AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, ADOPTING AN AMENDMENT TO THE INTERGOVERNMENTAL COORDINATION ELEMENT (ICE) OF THE CITY OF TAMARAC COMPREHENSIVE PLAN TO ADDRESS COORDINATION EFFORTS AMONG GOVERNMENT AGENCIES THAT RELATE TO CONSERVATION OF NATURAL AREAS, PARKS AND RECREATION AREAS AND PRESERVATION OF OPEN SPACES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, provisions of the Local Government Comprehensive Planning and Land Development Regulation Act of 1985 require adoption of a comprehensive plan; and WHEREAS, the City of Tamarac, Florida, pursuant to said Local Government Planning Act and in accordance with all its terms and provisions, has prepared and adopted a Comprehensive Plan which has been submitted to and reviewed by the South Florida Regional Planning Council (SFRPC) and the Florida State Department of Community Affairs (DCA); and WHEREAS, the City of Tamarac Comprehensive Plan contains elements providing for conservation, open space and recreation; and WHEREAS, the City plans to acquire the Tamarac Sports Complex Phase II parcel (Kings Point Replat, Parcel R) in cooperation with other government agencies for the September 5, 2002 - Temp. Ord. #1976 2 purposes of meeting the conservation, recreation and open space elements of the City of Tamarac Comprehensive Plan; and WHEREAS, the Florida Communities Trust, through the Florida Forever Program, provides grants to assist local governments in implementing the conservation, recreation and open space elements of local comprehensive plans; and WHEREAS, City staff proposes and provides for appropriate Comprehensive Plan Goals, Policies and Objectives; and WHEREAS, the City has prepared an amendment to the Policies of the Intergovernmental Coordination Element (ICE) of the City's adopted Comprehensive Plan to address coordination efforts among government agencies that relate to natural areas, parks and recreation areas and open spaces; and WHEREAS, the City has provided multiple opportunities for public input including both public meetings and public hearings in order to obtain and consider public input regarding the proposed changes to the Comprehensive Plan; and WHEREAS, the Planning Board of the City of Tamarac, as the Local Planning Agency, has reviewed the amendment to the Intergovernmental Coordination Element of the Comprehensive Plan (attached hereto as Exhibit "A"), held a public hearing on September 4, 2002 and recommended approval; and WHEREAS, the Director of Community Development recommends approval; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interests of the citizens and residents of the City of Tamarac to coordinate with other 1 1 September 5, 2002 - Temp. Ord. #1976 government agencies to conserve natural areas and enhance open space, recreation and park opportunities for the citizens of the City of Tamarac. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance upon adoption hereof. SECTION 2: That the amendment to the Intergovernmental Coordination Element of the City of Tamarac's Comprehensive Plan (Case No. 2-LUA-02) reviewed by the Planning Board and approved by the City Commission, attached hereto and made a part of this Ordinance as shown on Exhibit "A", to address coordination efforts among government agencies that relate to natural areas, parks and recreation areas and open spaces, is HEREBY APPROVED. SECTION 3: All Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. SECTION 5: passage and adoption. September 5, 2002 - Temp. Ord. #1976 4 This Ordinance shall become effective immediately upon its PASSED, FIRST READING this 11th day of September, 2002. DIST 4: V/M ROBERTS c 1 1 EXHIBIT "A" TEMP ORD #1976 CITY OF TAMARAC Proposed Amendment to the Comprehensive Plan (Underlined sections represent changes/additions to the Comprehensive Plan) The following amendment to Objective 1 and new policy will be incorporated into the Intergovernmental Coordination Element of the City's adopted Comprehensive Plan: Objective 1 The City will send this plan to all adjoining municipalities, to the Broward County Planning Council as the county certifying agency, to the School Board, to the SFRPC, SFWMD, and to the state's land planning agency as provided in the State law for review and comment. The City will continue through the planning period to seek review and comment from other appropriate units of government on all development proposals, proposed plan amendments, proposed razoring, annexation, and other matters which affect or may be affected by the plans of the City of Tamarac. Particular attention will be given to coordination in the development and adoption of Levels of Service (LOS) standards for public facilities with state, regional, and local agencies with monitoring, operational, or maintenance responsibilities for public facilities in Tamarac. Policy 1_.11 The City will coordinate with other federal, state, and local agencies or nonprofit organizations in acquiring or manacling natural areas ark and recreation areas and open spaces within the City of Tamarac.
