HomeMy WebLinkAboutCity of Tamarac Ordinance O-2003-017Temp Ordinance #2011 June 9, 2003 Page 1 of 1 Revision 1, June 13, 2003 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2003- 1 7 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AMENDING CHAPTER 22 ENTITLED, "UTILITIES", ARTICLE III ENTITLED, "RATES AND CHARGES AND BILLING PROCEDURE", DIVISION 2 ENTITLED, "CITY OF TAMARAC UTILITY", SECTION 22-96, ENTITLED, "RATES AND CHARGES APPLICABLE TO CITY UTILITY", ADDING THE REQUIREMENT FOR AUTOMATIC ANNUAL ADJUSTMENTS TO WATER AND WASTEWATER SERVICE AVAILABILITY CHARGES AND CONSUMPTION RATES PURSUANT TO THE U.S. CONSUMER PRICE INDEX FOR THE PERIOD; PROVIDING FOR CODIFICATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, it is the responsibility of the Director of Utilities and the Director of Finance of the City of Tamarac, Florida to ensure that adequate revenues exist to cover operation, maintenance, replacement and debt service expenses; and WHEREAS, the Water and Wastewater Rate Sufficiency Study conducted by Williams, Hatfield & Stoner and Hartman & Associates, Inc., recommended an annual rate adjustment based on a price index in order to mitigate the need for large rate increases in the future; and WHEREAS, Section 22-96 of the City of Tamarac Code of Ordinances must be amended to authorize the adoption of automatic annual adjustments to water and wastewater service availability charges and consumption rates pursuant to the U.S. Consumer Price Index for the period; and CODING: Words inStFUGk threugh type are deletions from existing law. Temp Ordinance #2011 June 9, 2003 Page 2 of 2 Revision 1, June 13, 2003 WHEREAS, the U.S. Consumer Price Index is a customary national standard used to establish rate adjustments; and WHEREAS, the amendment will become effective October 1, 2004, and everyyear thereafter; and WHEREAS, the Director of Utilities and the Director of Finance recommend approval of the proposed amendment to Chapter 22, Article III, Division 2, Section 22-96; FWe WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to amend Chapter 22 Entitled "Utilities", Article III entitled, "Rates and Charges and Billing Procedure", Division 2 entitled, "City of Tamarac Utility", Section 22-96 entitled, "Rates and Charges Applicable to City Utility" to provide annual rate adjustments commensurate with the U.S. Consumer Price Index. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, THAT: SECTION 1: The foregoing whereas clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof. Temp Ordinance #2011 June 9, 2003 Page 3 of 3 Revision 1, June 13, 2003 SECTION 2: Section 22-96 of the Tamarac Code is hereby amended to read as follows: Sec. 22-96. Rates and charges applicable to city utility. The rates and charges applicable to the utility shall be established by resolution of the city commission after a public hearing noticed in a newspaper of general circulation no less than three (3) days prior to the public hearing. However, if the city commission finds and determines that an emergency situation exists, it may waive the advertising requirements and may, by resolution, modify existing rates and charges. Commencing on October 1 2004 and effective on the 1 St of October of each year thereafter, all water and wastewater service availability charges and consumption rates then in effect will be adjusted automatically, without further action by_ the City Commission, in accordance with the U.S. Consumer Price Index as determined in June of the calendar year of admustment. However, the city may establish an initial rate schedule concurrently with the enactment of this chapter and without the necessity of a public hearing thereon. SECTION 3. It is the intention of the City Commission and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Tamarac, Florida, and that the Sections of this Ordinance may be renumbered or relettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 4. All Ordinances or parts of Ordinances and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5. If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable.
