HomeMy WebLinkAboutCity of Tamarac Ordinance O-2003-031Ll �7 1 Temp Ordinance #2028-October 27, 2003 Page 1 CITY OF TAMARAC, FLORIDA ORDINANCE NO. 0-2003- -3 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, AUTHORIZING THE GRANTING OF AN ADDITIONAL HOMESTEAD TAX EXEMPTION OF $15,000 (FOR THE MAXIMUM $25,000 EXEMPTION AMOUNT) TO RESIDENT HOMEOWNERS WHO HAVE LEGAL OR EQUITABLE TITLE TO REAL ESTATE, WHO ARE AT LEAST 65 YEARS OF AGE, AND WHOSE ANNUAL HOUSEHOLD INCOME DOES NOT EXCEED THE ALLOWABLE AMOUNT PURSUANT TO SECTION 196.075, FLORIDA STATUTES (1999), AS AMENDED; THAT ANY TAXPAYER CLAIMING THE EXEMPTION MUST ANNUALLY SUBMIT A SWORN STATEMENT OF HOUSEHOLD INCOME, ON A FORM PRESCRIBED BY THE DEPARTMENT OF REVENUE TO THE PROPERTY APPRAISER, NOT LATER THAN MARCH 1 OF EACH YEAR; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, during the 1999 Legislative Session, the Florida Legislature enacted Chapter 99-341 of the Laws of Florida, enrolled as Section 196.075, Florida Statutes, in accordance with express authority provided in recent revision of the State Constitution; and WHEREAS, Section 196.075, Florida Statutes, provides that counties and municipalities may adopt an ordinance to allow an additional homestead tax exemption for a total maximum allowable amount of Twenty -Five Thousand Dollars ($25,000) to any person who has the legal or equitable title to real estate and maintains thereon the permanent residence of the owner, who meets the statutory age, income and residency requirements of Section 196.075, Florida Statutes; and Temp Ordinance #2028-October 27, 2003 Page 2 WHEREAS, the City Commission of the City of Tamarac wishes to extend such additional homestead exemption from City of Tamarac ad valorem taxes to any person who meets the statutory age, income and residency requirements of Section 196.075, Florida Statutes; and WHEREAS, the City Commission of the City of Tamarac pursuant to Ordinance 0- 2002-32 granted an additional homestead exemption in the amount of Ten Thousand Dollars ($10,000) to any person who meets the statutory age, income and residency requirements of Section 196.075, Florida Statutes; and WHEREAS, the City Commission of the City of Tamarac has deemed it to be in the best interest of the citizens and residents of the City of Tamarac to grant an additional homestead tax exemption of Fifteen Thousand Dollars ($15,000) for a total maximum allowable amount of Twenty -Five Thousand Dollars ($25,000) to any person who meets the statutory age, income and residency requirements of Section 196.075, Florida Statutes. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Ordinance upon adoption hereof. Temp Ordinance #2028-October 27, 2003 Page 3 SECTION 2: That the City of Tamarac does hereby authorize the granting of an additional homestead tax exemption of Fifteen Thousand Dollars ($15,000) for a total maximum allowable amount of Twenty -Five Thousand Dollars ($25,000) for persons who meet the statutory age, income and residency requirements of Section 196.075, Florida Statutes, as amended; and SECTION 3: That the exemption may only apply to taxes levied by the City of Tamarac and such other units of local government authorizing the exemption. SECTION 4: That any taxpayer claiming the exemption must annually submit a sworn statement of household income, on a form prescribed by the Department of Revenue, to the property appraiser, not later than March 1 of each year. SECTION 5: All Ordinances or parts of Ordinances, and all Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given affect without the invalid provision or application, and to this end the provisions of this Ordinance are declared to be severable. 1 Temp Ordinance #2028-October 27, 2003 Page 4 SECTION 7: This Ordinance shall become effective immediately upon its passage and adoption.
